<br /> AMENDMENT TO AGREEMENT BETWEEN INDIAN RIVER COUNTY,
<br /> FLORIDA, AND THE BOARD OF TRUSTEES, INDIAN RIVER COUNTY
<br /> LAW LIBRARY
<br /> THIS AMENDMENT is made as of this 13 day of November , 2012 , by and
<br /> between Indian River County, a political subdivision of the State of Florida ("County") , and the
<br /> Board of Trustees, Indian River County Law Library, a special agency created by Chapter 57-
<br /> 1410 , Laws of Florida ("Trustees") , to that certain Agreement Between Indian River County,
<br /> Florida, and the Board of Trustees , Indian River County Law Library, dated July 18 , 1989
<br /> ("Agreement") . .

<br /> WITNESSETH :
<br /> WHEREAS , in 1957 , the Florida Legislature enacted Chapter 574410 , Laws of Florida,
<br /> which created the Trustees and authorized the Trustees to establish, operate and maintain a law
<br /> library for the citizens of Indian River County ; and
<br /> WHEREAS , subsequent to 1957 , and acting pursuant to Chapter 57- 1410, Laws of
<br /> Florida, the Trustees established, operated and maintained a law library in the then existing
<br /> Indian River County Courthouse; and
<br /> WHEREAS , on July 18 , 1989 , the County and the Trustees entered into the Agreement
<br /> which transferred to the County complete responsibility for operating and maintaining the law
<br /> library ; and
<br /> WHEREAS , in section 3 of the Agreement, the County acknowledged that as long as the
<br /> Agreement is in effect, the law library will be located in the existing or any future Indian River
<br /> County Courthouses and
<br /> WHEREAS , the parties now desire to amend section 3 of the Agreement to create
<br /> certain flexibility with respect to the location of the law library, as set forth herein,
<br /> NOW, THEREFORE , in consideration of the mutual undertakings set forth herein, and
<br /> for other good and valuable consideration, the receipt and adequacy of which is hereby
<br /> acknowledged, the parties agree, as follows :
<br /> 1 . Recitals . The above recitals are true and correct, and are incorporated herein.
<br /> 2 . Amendment of Section 3 . Section 3 of the Agreement is hereby deleted in its
<br /> entirety and replaced with the following language : "As a material consideration for this
<br /> agreement, the County acknowledges that as long as this operation contract is in force and effect,
<br /> the law library will not be moved from the vicinity of the Indian River County Courthouse . The
<br /> County is specifically authorized to move the law books to the main public library located at
<br /> 1600 20 Street, Vero Beach, Florida, and to maintain one or more computer terminals in the
<br /> courthouse for use by attorneys and members of the public conducting electronic legal research . "
