Lucas Marine
Explanation of Liquidated Damages
Lucas Marine has had only one ( 1 ) instance of liquidated damages in its many
years of business . The details are as follow :
This project had many complications throughout construction that created delays that were
beyond our control , but resulted in liquidated damages .
1 ) Design changes — There was a multitude design changes and each occurrence slowed
construction .
2 ) Differing site conditions — Differing site conditions were encountered that should have
warranted a time extension ; however, a caveat in our contract terms had extraordinary reporting
requirements . Had we reported the conditions within 24 hours of discovery, the extension would
have been granted and the damages would have been greatly reduced .
3 ) Subcontractors — The County strictly required 15 % SBE participation . Some of the SBE subs
caused delays in the overall project, one of which actually went out of business and abandoned
the project. Lucas Marine completed their portion of the work with its own forces , but we could
not overcome the substantial delay in the schedule . The County did not see fit to grant
an
extension for the Small Business Enterprise ' s failure to perform .
Project Information :
South Lake Worth Inlet Project
Completed 2011
Palm Beach County BOCC
Owner Representative — Bridge Design Assoc .
Jason Hanchuk ( 561 ) 686- 3660
