Lucas Marine <br /> Explanation of Liquidated Damages <br /> Lucas Marine has had only one ( 1 ) instance of liquidated damages in its many <br /> years of business . The details are as follow : <br /> This project had many complications throughout construction that created delays that were <br /> beyond our control , but resulted in liquidated damages . <br /> 1 ) Design changes — There was a multitude design changes and each occurrence slowed <br /> construction . <br /> 2 ) Differing site conditions — Differing site conditions were encountered that should have <br /> warranted a time extension ; however, a caveat in our contract terms had extraordinary reporting <br /> requirements . Had we reported the conditions within 24 hours of discovery, the extension would <br /> have been granted and the damages would have been greatly reduced . <br /> 3 ) Subcontractors — The County strictly required 15 % SBE participation . Some of the SBE subs <br /> caused delays in the overall project, one of which actually went out of business and abandoned <br /> the project. Lucas Marine completed their portion of the work with its own forces , but we could <br /> not overcome the substantial delay in the schedule .
