i <br />RESOLUTION NO. 71- 6 <br />The Board of County Commissioners of Indian River County, Florida, <br />resolves: <br />1. Under date of January 20, 1969, The Moorings Development <br />Company, a Florida corporation, did enter into a performance bond as princi- <br />pal in which it bound itself unto Indian River County, Florida, a political sub- <br />division of the State of Florida, in the sum of $230, 000.00 in connection with <br />that principal having submitted to the Board of County Commissioners cif <br />Indian River County, Florida, for approval a plat of a subdivision known as <br />The Moorings, Unit One, which was to be recorded as provided by Chapter <br />29155, Laws of Florida, Acts of 1953, and as provided by the Subdivision <br />Resolution of Indian River County, Florida, and which said plat was subse- <br />quently recorded in the office of the Clerk of the Circuit Court of Indian River <br />County, Florida, in Plat Book 8, page 6. <br />2. Said bond was conditioned upon the completion and installation of <br />all of the improvements shown upon the preliminary plat or required pursuant <br />to the Subdivision Resolution and in lieu of its execution by a surety company <br />the principal did deposit the total amount of money in cash with the above <br />Clerk and in reliance thereon said board approved said plat for recording. <br />3. All of the conditions of said performance bond have been kept and <br />completed and the County Administrator has certified to said Clerk that all of <br />the improvements have been constructed on the land and the balance of the <br />cash deposit has been returned by the Clerk to the principal, whereupon in <br />accordance with the terms and conditions of the bond, the same has become <br />null and void, however, in view of the fact that said bond has been recorded in <br />the office of said Clerk in Official Record Book 308, page 390, it is necessary <br />that evidence of the full and complete compliance with the terms of said bond <br />be evidenced by Resolution of this board. This board does herewith find and <br />determine that said bond and the obligation created thereby has become null <br />and void and does herewith direct that a certified copy of this Resolution evi- <br />dencing such fact shall be recorded in the public records of Indian River <br />County,- Florida. <br />FEB 101911 <br />Smith, Heath, Smith & O'Haire, Attorneys At Law, P.
