SMITH , CLERK .� <br /> LF G L - N 1� tJ G `4 640 1 <br /> 6R l 61 TERMINATION OF e leu <br /> COVENANT DEFERRING MAINTENANCE SECURITY <br /> FOR DEVELOPMENT <br /> ( Pursuant to Section 913 . 09 (5) , Indian River County Code ) <br /> WHEREAS , Pointe West of Vero Beach , Ltd . , a Florida limited partnership , <br /> and The Links at Pointe West, L . L . C . , a Florida limited liability company , the <br /> owners of property known as Pointe West East Village Phase 1 P . D . , as <br /> recorded in Plat Book 22 , Page 59 , Public Records of Indian River County , <br /> Florida , imposed a Covenant to Defer Maintenance Security for <br /> Development affecting certain property within the subdivision which was <br /> recorded in Official Record Book 2326 , Page 256 of the Public Records of <br /> Indian River County , Florida ; and <br /> WHEREAS , by instrument recorded in Book 2465 , Page 2191 , a portion of <br /> the property was released from said Covenant to Defer Maintenance <br /> Security for Development ; and <br /> WHEREAS , by Modification to Covenant Deferring Maintenance Security for <br /> Development, recorded in Book 2472 , Page 812 of the Public Records of <br /> Indian River County , Florida , the property continuing to be in deferral was <br /> redefined as depicted on Exhibit " A" attached hereto ; and <br /> WHEREAS , the owners have now requested the Board of County <br /> Commissioners release the remainder of the property under the Covenant <br /> to Defer Maintenance Security for Development recorded in Official Record <br /> Book 2326 , Page 256 and as further recited in Book 2465 , Page 2191 , and <br /> as redefined by instrument recorded in Book 2472 , Page 812 , all of the <br /> Public Records of Indian River County , Florida ; and in consideration <br /> thereof, the owners have posted the appropriate security to warranty the <br /> road and drainage improvements against defects in materials and <br /> workmanship for a 1 -year period for the property depicted on the attached <br /> Exhibit " A" ; and <br /> WHEREAS , the termination of said Covenant to Defer Maintenance Security <br /> for Development over the property described in Official Record Book 2326 , <br /> Page 256 and as redefined in Book 2472 , Page 812 of the Public Records of <br /> Indian River County , Florida , requires the approval in writing by the Board <br /> of County Commissioners of Indian River County by recorded document ; <br /> 1 <br />
