Any rights , interests , or claims of parties in possession of the Land not shown by the Public Records . <br /> 2 . Any encroachment, encumbrance, violation , variation , or adverse circumstance affecting the Title that would be <br /> disclosed by an accurate and complete land survey of the Land . The term " encroachment" includes encroachments of <br /> existing improvements located on the Land onto adjoining land , and encroachments on the Land <br /> of existing <br /> improvements located on adjoining land . <br /> 3 . Easements or claims of easements not shown by the Public Records , <br /> 4 . Any lien , or right to a lien , for services , labor or materials in connection with improvements, repairs or renovations <br /> provided before, on , or after Date of Policy, not shown by the Public Records . <br /> 5 . Any dispute as to the boundaries caused by a change in the location of any water body within or adjacent to the Land <br /> prior to Date of Policy, and any adverse claim to all or part of the Land that is , at Date of Policy, or was <br /> previously, <br /> under water. <br /> 6 . Taxes or special assessments not shown as liens in the Public Records or in the records of the local tax <br /> collecting <br /> authority, at Date of Policy. <br /> 7 . Any minerals or mineral rights leased, granted or retained by current or prior owner. <br /> 8 . Taxes and assessments for the year 2012 , and subsequent years, which are not yet due and payable . <br /> 9 . Any lien as provided for by Chapter 159, Florida Statutes, in favor of any city, town, village or port <br />authority for <br /> unpaid service charges for service by any water, sewer, or gas systems supplying the lands described herein . (Owner's <br /> Policy only ) <br /> 10 . Rights of property owners whose property abuts Blue Cypress Lake in and to the bed <br /> or submerged portions thereof; also, any rights of those owners to use said Blue <br /> Cypress Lake for boating, fishing or other recreational purpose, drainage or common <br /> purposes . <br /> 11 . This commitment or policy does not insure the nature or extent of riparian or littoral <br /> rights . <br /> 12 . Any claim to any portion of the property described in Schedule " A " which lies below <br /> the ordinary high water line of Blue Cypress Lake and other adjacent waters , if any . <br /> 13 . Notwithstanding any other insuring clauses contained herein , this commitment or <br /> policy DOES NOT insure ingress and egress . <br /> 14 .
