If within one ( 1 ) year after the date of substantial <br /> completion or such longer period of time as may be prescribed by law or by the <br /> terms of any applicable special guarantee required by the Contract Documents or <br /> by any specific provision of the Contract Documents , any work is found to be <br /> defective , the CONTRACTOR shall promptly, without cost to the COUNTY and <br /> in accordance with the COUNTY ' s written instructions , either correct such <br /> defective work, or, if it has been rejected by the COUNTY, remove it from the <br /> site and replace it with non- defective work . If the CONTRACTOR does not <br /> promptly comply with the terms of such instructions , or in an emergency where <br /> delay would cause serious risk of loss or damage , the COUNTY may have the <br /> defective work corrected or the rejected work removed and replaced, and all <br /> direct and indirect costs of such removal and replacement, including <br /> compensation for additional professional services , shall be paid by the <br /> CONTRACTOR . <br /> 32 . 244 The CONTRACTOR will not be held responsible for loss or erosion of the beach <br /> fill after final acceptance by the ENGINEER. <br /> Page 12 of 26 <br /> March 16, 2010 <br />
