BARTON , CLERK THIS DOCUMENT HAS BEEN <br /> RECORDED IN THE PUBLIC RECORDS <br /> 756 Beachland Blvd , OF INDIAN RIVER COUNTY FL <br /> Vero Beach , FL 32963 BK 2448 PGA97 , Paget of 3 <br /> 09!29!2010 a' 04: 13 PM , <br /> JEFFREY K BARTON , CLERK OF COURT <br /> CORRECTIVE EASEMENT <br /> r; <br /> THIS EASEMENT is made this 1 day of � u� , 2010 by MARINE <br /> RESOURCES COUNCIL OF EAST FLORIDA , INC . , a nonprofit environmental <br /> organization , ("Grantor"), to INDIAN RIVER COUNTY , a political subdivision of the <br /> State of Florida, its successors and assigns, ("Grantee'! : <br /> WITNESSETH : <br /> Grantor, for and in consideration of One Dollar ($ 1 .00) and other good and <br /> valuable consideration, the receipt and sufficiency of which is hereby acknowledged , <br /> hereby grants to Grantee , its successors and assigns, a non-exclusive, easement for <br /> pedestrian and vehicular ingress and egress over, upon, and across the following <br /> described property located in Indian River County, Florida : <br /> SEE EXHIBIT "A " ATTACHED HERETO AND MADE A PART HEREOF. <br /> This corrective easement amends the language of the easement recorded in the <br /> Official Records Book 2405 , Page 1557 of Indian River County , Florida. <br /> WHEREAS, Grantor has acquired the property with partial funding from the <br /> Florida Communities Trust (FCT), and the Property is subject to certain limitations <br /> provided in the FCT Grant Award Agreement (as recorded in OR Book 1985 , Page 135 <br /> in Indian River County, Florida)(tlhe "Agreement ,") and <br /> WHEREAS, as part and condition of the FCT fimding, the City provided and FCT <br /> approved a Management Plan for the project site, and together with the Agreement, the <br /> terms of which are hereby incorporated herein by reference; and <br /> WHEREAS, FCT shall be notified of all leases, easements or other similar <br /> documents that affect property funded by FCT; and <br /> WHEREAS, the Agreement's restrictions on the FCT funded property are <br /> superior to any other restrictions placed upon the property; and <br /> WHEREAS, Grantor intends that the conservation and recreation values of the <br /> Property be preserved and enhanced in accordance with the Management Plan, as it may <br /> be amended from time to time only after review and approval by FCT; and <br /> WHEREAS, All activities by the Grantor and Grantee shall be consistent with the <br /> Agreement and Management Plan. <br />
