PETITION FOR VACATION OF COUNTY ROAD <br />TO THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY: <br />Comes now the Petitioner, WYN COVE, INC., a Florida corporation, <br />and petitions the Commission as follows: <br />1. That it is the owner of the following described property: <br />All of WYN COVE, according to plat filed in the office of the Clerk of <br />the Circuit Court of Indian River County, Florida, in Plat Book 4, page <br />61; LESS AND EXCEPTING, however, the following described property: <br />Lots 14 and 18 and that part of Parcel "A" as described in Official Record <br />Book 154, page 399, public records of Indian River County, Florida; said <br />land lying and being in Indian River County, Florida. <br />2. That it does hereby petition and request this Honorable Board to close, <br />vacate and abandon that certain street known as Vanada Lane, being 76.2 feet <br />in width, lying between.Lots 10 and 11, and between Lots 16 and 17, as shown <br />on plat of Wyn Cove, recorded in Plat Book 4, page 61, public records of Indian <br />River County, Florida. The particular street being requested to be vacated <br />has never been opened and has never been used in any manner and the said <br />street does not extend* either Northerly or Southerly from the aforesaid. sub- <br />division. The petitioner owns all of the property in said Wyn Cove Subdivision <br />except for Lots 14 and 18 which lots were deeded with the provision typed on <br />the deed that by recording the said deed the grantors were agreeing and consent- <br />ing to the vacation of Vanada Lane, as shown on said plat. The said Vanada Lane <br />is not necessary for. ingress or egress, and petitioner is the owner of all lands <br />abutting and adjoining the said street. <br />3. That your Petitioner requests that said street be vacated, abandoned, <br />discontinued and closed as it now exists on said plat of Wyn Cove and that the <br />Board of County Commissioners of Indian River County reserve unto the said <br />county a 10 -foot public utility and drainage easement over the Northerly 10 feet <br />of Vanada. Lane and over the Southerly 10 feet of Vanada Lane, as shown on plat <br />of Wyn Cove as above described, and that said Board renounce and disclaim any <br />right of the county and of the public in and to said street as shown on said plat <br />and reserve unto the county the 10 -foot easements as aforesaid. <br />4.
