They were informed that most of the trees were on <br />Ben Bailey's property and that the Board has no jurisdiction to <br />cut down trees on private property. <br />On Motion of Commissioner McCullers, second of Commissioner <br />Loy, the following Resolution was unanimously adopted: <br />RESOLUTION NO. 71-45 ' <br />WHEREAS, the Board of County Commissioners of Indian <br />River County is authorized, under the provisions of Section 336.59 <br />of the Florida Statutes, to levy an annual tax; for road and bridge <br />purposes; and <br />WHEREAS, under the provisions of said Section 336. 59 of <br />the Florida Statutes, it is provided that one-half of the amount <br />realized from such special tax on property within the City Limits <br />of Indian River Shores shall be turned over to said City to be used <br />solely for the purpose of maintaining and repairing the roads and <br />streets of said City; and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County, Florida, and the City Council of the City of Indian <br />River Shores, have agreed on an accounting for the taxes collected <br />within the City Limits of the City of Indian River Shores, from <br />January 1,_ 1959 to May 17, 1971, under the .provisions of Section <br />336.59 of the Florida Statutes, and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County and the City Council of the City. of Indian River Shores <br />have mutually agreed to the following payment schedule for payment <br />of funds owed by the County to the City, to be paid immediately. - <br />$8, 460. 39, 1972 - $5,,000.-00, 1973 - $5, 000. 00 and 1974 $5, 000. 00, <br />which amounts the Board of County Commissioners will budget in the <br />future, and <br />WHEREAS, the City has agreed to discharge the County from <br />any liability for Road & Bridge Funds for any amount owed prior to <br />January 1, 1959. <br />AUG 4 1971 <br />
