The Board then adjourned at 12:00 o'clock Noon and <br />reconvened at 1:35 o'clock P. M. Commissioner McCullers was <br />absent. <br />On Motion of Commissioner.Loy, second of Commissioner <br />Dritenbas, the Board unanimously entered into and approved the <br />signature of the Chairman on the following agreement: <br />FORM 132.10 • STATE OF FLORIDA DEPARTMENT OP TRANSPORTATION <br />rr+ State^cnndary Road System _ <br />MAINTE44ANCE AGREEMENT <br />(STAT$ MAINTAINED) - <br />THIS AGREEMENT, made' this dad of <br />19 , by and between OF FLORIDA <br />DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida, hereinafter Called the. <br />"Department", and the. COUNTY OF , a political subdivision <br />of the State of Florida, acting by and through its Board of County Commissioners, hereinafter called <br />the 'County"; <br />WITNESSETH: - <br />WHEREAS, the: 1971 Session of the Florida Legislature through House Bill 1681 amended <br />Section 206.60(2)(h), to provide for the return to the counties of that portion of the seventh cent gas <br />tax which presently gbes to the Department and assigned the responsibility for maintaining roads in <br />the Secondary Road System to the counties; and <br />WHEREAS, Florida Statutes 335.0.11 requires that the maintenance of the roads, streets or <br />highways and municipal connecting links constructed or reconstructed with funds accruing to the. <br />Division of Road Operations of the Department for use in the various counties from the fifth, sixth <br />and seventh cent gasoline tax funds, shall be determined by a cooperative agreement between the <br />boards of county commissioners and the Division of Road Operations; and <br />WHEREAS, under the provisions of House Bill 1681, the County is desirous that the Department <br />undertake the maintenance of all roads now or hereafter placed on the State Secondary Road System <br />during the duration of this Agreement; <br />NOW, THEREFORE, for and in consideration of the: premises, it is mutually agreed by and <br />between the Department and the County as follows: <br />1. The County covenants and agrees that upon the execution and delivery of this Contract that <br />it shall cause to be deposited with the Department the sum of ? ' 6 0 . c o ? , to be <br />used by the Department, as an operating fund for the maintenance of the roads required by this <br />Agreement to be maintained by the Department. <br />2. The Department covenants and agrees that until such time as this Agreement is terminated it <br />shall maintain all roads on the State Secondary Road System within the, county in accordance with the <br />usual standards and requirements of the Division of Road Operations of the Department of <br />Transportation. <br />3. The Department agrees that it shall maintain accurate records reflecting the actual costs of <br />such maintenance and that these records shall be .maintained by the Department at its Tallahassee <br />office and made available to the County for inspection and/or copying during the regular business <br />' BOOK 1 fAGL 48..�:.. <br />.
