The Board then adjourned at 12:00 o'clock Noon and reconvened at 1:35 o'clock P. M. Commissioner McCullers was absent. On Motion of Commissioner.Loy, second of Commissioner Dritenbas, the Board unanimously entered into and approved the signature of the Chairman on the following agreement: FORM 132.10 • STATE OF FLORIDA DEPARTMENT OP TRANSPORTATION rr+ State^cnndary Road System _ MAINTE44ANCE AGREEMENT (STAT$ MAINTAINED) - THIS AGREEMENT, made' this dad of 19 , by and between OF FLORIDA DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida, hereinafter Called the. "Department", and the. COUNTY OF , a political subdivision of the State of Florida, acting by and through its Board of County Commissioners, hereinafter called the 'County"; WITNESSETH: - WHEREAS, the: 1971 Session of the Florida Legislature through House Bill 1681 amended Section 206.60(2)(h), to provide for the return to the counties of that portion of the seventh cent gas tax which presently gbes to the Department and assigned the responsibility for maintaining roads in the Secondary Road System to the counties; and WHEREAS, Florida Statutes 335.0.11 requires that the maintenance of the roads, streets or highways and municipal connecting links constructed or reconstructed with funds accruing to the. Division of Road Operations of the Department for use in the various counties from the fifth, sixth and seventh cent gasoline tax funds, shall be determined by a cooperative agreement between the boards of county commissioners and the Division of Road Operations; and WHEREAS, under the provisions of House Bill 1681, the County is desirous that the Department undertake the maintenance of all roads now or hereafter placed on the State Secondary Road System during the duration of this Agreement; NOW, THEREFORE, for and in consideration of the: premises, it is mutually agreed by and between the Department and the County as follows: 1. The County covenants and agrees that upon the execution and delivery of this Contract that it shall cause to be deposited with the Department the sum of ? ' 6 0 . c o ? , to be used by the Department, as an operating fund for the maintenance of the roads required by this Agreement to be maintained by the Department. 2. The Department covenants and agrees that until such time as this Agreement is terminated it shall maintain all roads on the State Secondary Road System within the, county in accordance with the usual standards and requirements of the Division of Road Operations of the Department of Transportation. 3. The Department agrees that it shall maintain accurate records reflecting the actual costs of such maintenance and that these records shall be .maintained by the Department at its Tallahassee office and made available to the County for inspection and/or copying during the regular business ' BOOK 1 fAGL 48..�:.. .
