SEC. 27 completed SEC. 28 <br />the Indian River County Zoning Commission, amend, supple- <br />ment, change, modify, or repeal by ordinance pursuant to <br />the :authority and in the manner provided by State Law this <br />ordinance or the boundaries or districts or ordinance here- <br />in established. <br />(B) CHANGES OR AMENDMENT PROCEDURES: <br />Any person desiring a change or amendment to the Zoning or- <br />dinance or Zoning Map shall submit the same, in writing, to <br />the County Administrator describing by legal description and <br />by street address., where possible, the property to be affect- <br />ed by the proposed change, setting forth the present zoning <br />applicable thereto and specifying the district, zone and -use <br />requested. The applicant shall nay to the County the sum of <br />$50.00 for each such requested change; provided, however, <br />that as many lots or parcels of property as the applicant <br />may desire may be included.in any single petition if they <br />constitute one contiguous area. The County Administrator <br />shall then transmit the application to the Zoning Commiss- <br />ion for tentative consideration at its next meeting. Should <br />the Zoning Commission tentatively approve the petition, it <br />shall report its tentative approval to the Board of County <br />Commissioners, and should the Board of County Commissioners <br />tentatively approve the same, public hearings shall be held. <br />Should either the Zoning Commission or the Board of County <br />Commissioners upon their tentative consideration, disapprove <br />the application and the applicant elects to proceed no fur- <br />ther, then the fee deposited with the County shall be return <br />ed to the applicant, otherwise, the.fee shall remain the prop- <br />erty of the County. Should public hearings beheld, then in <br />connection with the publication of the notice for the public <br />hearing before the Zoning Commission, the County Administrator <br />shall mail a written notice to all property owners of property <br />within 300 feet of the outer limits of the area described in <br />the petition requesting a chance, advising all such owners <br />as shown upon the last prepared and completed Tax Assessment <br />Roll of the County, in simple terms, the proposed change and <br />the time and place of the public hearing. In the event more <br />than 500 lots or. parcels are being rezoned, notification shall <br />be by public notice only. The provisions hereof providing <br />.for mailing notice is directory only, and the failure to mail <br />such notice shall not affect any change or amendment of said <br />Zoning Ordinance. <br />(C) PERMIT: <br />When a person requests a change in zoning of any district, <br />then the requested change, if granted, shall be contingent <br />upon the applicant obtaining a permit for the proposed con- <br />struction within six (6) months and.completing the construct- <br />ion within one year from the date of such change, or the Board <br />of County Commissioners may rezone the property to the ori- <br />ginal zoning. <br />(D) INTERIM ZONING:• <br />The Board of County Commissioners may adopt stop -gap or inter- <br />im zoning for periods of time not to exceed one year, design- <br />ed to preserve the status quo in any area in the County, pend- <br />ing the completion of comprehensive zoning,'water and sewer, <br />urban renewal or other similar.type,plans. <br />Section 28. LEGAL PROVISIONS: <br />(A) REPEAL OF PREVIOUS ZONING ORDINANCE: Zoning Regulations and <br />amendments thereto adopted ereto are are hereby repealed if <br />in conflict with this ordinance or any amendment thereto. <br />(B) PENDING PROSECUTION: In the event that there are unremedied <br />violations of any zoning regulation repealed by this ordin- <br />ance, which unremedied violations are also a violation of <br />this ordinance, the county shall have the same rights and <br />remedies as if the repealed regulation was still in effect. <br />SEP .8 19 '9 <br />
