SMITH , CLERK <br /> DUNS No. : 80-939-7102 Contract No . : A 0-72 <br /> CSFA No. : 55 . 009 FM No : 427572- 1 -58 -01 <br /> Vendor No : VF 596-000-674 <br /> STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br /> AND <br /> INDIAN RIVER COUNTY <br /> SMALL COUNTY OUTREACH PROGRAM AGREEMENT <br /> AMENDMENT NUMBER ONE <br /> THIS Amendment, made and entered into this day of , 20by and <br /> between the State of Florida Department of Transportation, an agency of the State of Florida, hereinafter called the <br /> DEPARTMENT, and Indian River County, 1801 27"' Street, Building A, Vero Beach, Florida 32960, hereinafter <br /> called the COUNTY. <br /> WITNESSETH <br /> WHEREAS , on June 18 . 2012 the parties entered into a Small County Outreach Program Agreement, <br /> hereinafter referred to as the Agreement, wherein the COUNTY agreed to provide certain improvements in <br /> connection with Financial Management (FM) No. 4275724 -58 -01 for Construction (reconstruction) of CR512 <br /> Eastbound Lanes Only from Roseland Road to Easy Street and hereinafter referred to as the Project; and <br /> WHEREAS , the parties hereto desire to amend the Agreement; and <br /> WHEREAS , the parties hereto mutually agree that this Amendment is in their best interest; <br /> NOW, THEREFORE, in consideration of the mutual covenants, promises and representations herein, the <br /> parties agree to amend the Agreement as follows : <br /> 1 . The recitals set forth above are true and correct and are deemed incorporated herein. <br /> 2 . Paragraph 3A of the Agreement is amended to read as follows : <br /> Except as otherwise set forth herein, this Agreement shall continue in effect and be binding to both the <br /> COUNTY and the DEPARTMENT until the Project is completed as evidenced by the written acceptance <br /> of the DEPARTMENT or December 31 , 2014 , whichever occurs first, or if terminated earlier <br /> in <br /> accordance with Paragraph 7 of the Agreement. <br /> 3 . This Amendment increases the total funding needed for the Construction of the Project by <br />THREE <br /> HUNDRED SEVENTY EIGHT THOUSAND FIVE HUNDRED SIXTY TWO DOLLARS AND NO <br /> CENTS ($ 378 ,562 . 00). The funding is being increased due to the final award amount being higher than <br /> the original estimate of the Project. Paragraph 4A of the Agreement is amended to read as follows : <br /> The total Project cost is NINE HUNDRED NINETY NINE THOUSAND SEVEN HUNDRED EIGHTY <br /> EIGHT DOLLARS AND NO CENTS ($999 ,788 . 00) . The DEPARTMENT will fund 75% of the cost of <br /> the Project which equals SEVEN HUNDRED FORTY NINE THOUSAND EIGHT HUNDRED FORTY <br /> ONE DOLLARS AND NO CENTS ($749, 841 . 00) , for the construction of the Project. The COUNTY <br /> shall be responsible for all costs in excess of the DEPARTMENT ' s participation. The COUNTY' S <br /> matching participation is in the form of Local (COUNTY) funds equal to 25 % of the Project costs plus <br /> the remaining portion of the accepted bid amount that exceeds the DEPARTMENT ' s participation. <br /> 1 of 3 <br />
