SMITH M Mr. Ralph Harris Clerk of the Circuit Court Indian River County Courthouse Vero Beach, Florida 32960 Re: Application For Funds Dear Ralph: According to our files, on or about February 1, 1968, you paid into the general funds of the county the sum of $111..17, representing the excess proceeds of a tax deed sale held May 1, ' 1967, pursuant to Tax Sale Certificate No. 1 issued May 1, 1963. You did this pursuant to Section 194.23, Florida Statutes, which provides, in part, as follows: ... After the funds ha ve been paid into the t general funds of the county, the owner may at any time in five years from the date of sale make application to the board of county commis- sioners for such funds, and such board may, if . satisfied that the applicant is entitled to the funds, order a warrant to be drawn for the amount due to the applicant, less the sum of one dollar on each hundred dollars of fraction thereof which shall be retained by the county to cover the ex- pensesthe county has been put to by reason of the applicant's negligence, .. " On behalf of our clients, Messrs. Elliott Northcott and Donald Macdonald, the former and present owner, respectively, of the lands involved, we herewith make application to the Board of County Commissioners of Indian River County for a warrant payable to Mr. Macdonald in the sum of $109.17 under and pursuant to said statute.
