SMITH M <br />Mr. Ralph Harris <br />Clerk of the Circuit Court <br />Indian River County Courthouse <br />Vero Beach, Florida 32960 <br />Re: Application For Funds <br />Dear Ralph: <br />According to our files, on or about February 1, 1968, <br />you paid into the general funds of the county the sum of $111..17, <br />representing the excess proceeds of a tax deed sale held May 1, ' <br />1967, pursuant to Tax Sale Certificate No. 1 issued May 1, 1963. <br />You did this pursuant to Section 194.23, Florida Statutes, <br />which provides, in part, as follows: <br />... After the funds ha ve been paid into the t <br />general funds of the county, the owner may at <br />any time in five years from the date of sale <br />make application to the board of county commis- <br />sioners for such funds, and such board may, if <br />. satisfied that the applicant is entitled to the funds, <br />order a warrant to be drawn for the amount due <br />to the applicant, less the sum of one dollar on <br />each hundred dollars of fraction thereof which <br />shall be retained by the county to cover the ex- <br />pensesthe county has been put to by reason of <br />the applicant's negligence, .. " <br />On behalf of our clients, Messrs.
