( 3 ) Recipient shall require the language of this certification to be included in the <br /> documents for sub -awards in excess of $ 100 , 000 at all tiers (including <br /> subcontracts , sub -grants , and contracts under grants , loans , and cooperative <br /> agreements) , and that all sub -recipients shall certify and disclose accordingly . <br /> B . This certification is a material representation of fact upon which reliance was placed <br /> when this transaction was made or entered into . Submission of this certification is a <br /> prerequisite for making or entering into this transaction imposed by section 1352 , title <br /> 31 , U. S . Code . Any person who fails to file the required certification shall be subject to <br /> a civil penalty of not less than $ 10 , 000 and not more than $ 100, 000 for each such failure . <br /> XI. DEBARMENT AND SUSPENSION <br /> A . In accordance with Executive Order 12549 , Debarment and Suspension , and the <br /> requirements of this sub -award contained in 2 CFR Part 180 , Subpart C (Attachment E) ; <br /> 2 CFR Part 1532 , and 40 CFR § § 31 . 35 , Recipient agrees and certifies that : <br /> ( 1 ) Neither Recipient, nor its principals , is presently debarred, suspended, proposed <br /> for debarment, declared ineligible , or voluntarily excluded from participation in <br /> this transaction by any Federal District or agency. <br /> (2) Recipient shall not knowingly enter into any lower tier contract , or other covered <br /> transaction , with a person who is similarly debarred or suspended from <br /> participating in this covered transaction, unless authorized in writing by USEPA <br /> to the District . Recipient shall pass the requirement to comply with the above- <br /> stated provisions to each person with whom Recipient enters into a covered <br /> transaction of $25 ,000 or more , as provided in 2 CFR Part 180 , Subpart B , by <br /> including the language of this section in all subcontracts or lower tier agreements <br /> executed to support Recipient ' s work under this Agreement . <br /> (3 ) Recipient shall check the federal Excluded Parties List System , currently at <br /> l ttp : //cpls . arnet , gov or littp : //www . epls . ,tiov for those persons who are ineligible <br /> to participate in federally funded transactions . <br /> XII. HOTEL-MOTEL FIRE SAFETY <br /> Pursuant to 40 CFR 30 . 18 , if applicable , and 15 USC 2225a, Recipient agrees to ensure that all <br /> space for conferences , meetings , conventions , or training seminars funded in whole or in part <br /> with federal funds complies with the protection and control guidelines of the Hotel and Motel <br /> Fire Safety Act (PL 101 -391 , as amended) . Recipients may search the Hotel-Motel National <br /> Master List at littp : //www . usfa . diis . g_ov/applications/hotel / to see if a property in compliance <br /> (FEMA ID is currently not required) , or to find other information about the Act . <br /> XIII . COPYRIGHT <br /> The USEPA and the District reserve a royalty-free , nonexclusive, and irrevocable license to <br /> reproduce, publish or otherwise use , and to authorize others to use , for government purposes : ( 1 ) <br /> the copyright in any work developed under a grant, subgrant, or contract under a grant or <br /> 6 <br />
