21 . 6 Newly hired probationary employees may be dismissed at any time at the <br /> discretion of the County and are not entitled to the grievance/arbitration <br /> procedures or payments of sick leave or vacation leave at time of termination . <br /> 21 . 7 If an employee who is serving a probationary period incurred as a result of a <br /> promotion is found to be unqualified to perform the duties of the higher position , <br /> a good faith effort will be made to return the employee to the position and status <br /> held immediately prior to the promotion . If the employee ' s former position is <br /> filled , the employee may be transferred to a vacant position for which the <br /> employee qualifies . If no vacancy exists for which the employee is qualified , the <br /> employee will be placed in a lay-off status with recall rights . <br /> 25 <br />
