SECTION 01060 <br /> REGULATORY REQUIREMENTS AND NOTIFICATION <br /> PART 1 - GENERAL <br /> 1 . 01 PERMITS REQUIRED <br /> A . Florida Department of Environmental Protection : The construction permit from the Florida <br /> Department of Environmental Protection ( FDEP ) for the project is being obtained . <br /> B . The Environmental Resource Permit ( ERP ) from the St. Johns Water Management District <br /> for the project has been obtained . <br /> C . Building Permits : The Contractor is required to obtain all applicable local building <br /> pennits from the County , such as concrete , plumbing , and electrical permits . The cost of <br /> these permits is to be drawn from an allowance to be included in the bid amount . Unused <br /> portions of the allowance for permits is to be returned to the County by final change <br /> order in the form of a deduct. Permit fees in excess of the allowance will be compensated <br /> by means of change order process . <br /> D . Indian River County Permits <br /> a . Tree Removal Pen-nit: The Contractor is responsible for obtaining this permit. <br /> b . Land Clearing Permit : The Contractor is responsible for obtaining this permit. ` <br /> c . Right- of- Way Permit: The Contractor is responsible for obtaining this permit. <br /> d . Stormwater Management System Permit : The SWMS permit from Indian River County <br /> for the project is being obtained . <br /> E. Florida Fish and Wildlife Conservation Commission ( FWC ) Permits : The Contractor <br /> shall be responsible for obtaining the services of a FWC Authorized Gopher Tortoise <br /> Agent to perform gopher tortoise burrow surveys within the project area and within 25 <br /> feet surrounding the project area . The project area that will require a gopher tortoise <br /> burrow survey includes any upland area in which the ground will be affected by the <br /> project including but not limited to egress and ingress areas , stockpile areas , staging <br /> areas , and any unpaved upland areas that will be used by Contractor vehicles . <br /> If any Potentially Occupied gopher tortoise burrow is found within the project area or <br /> within 254ect of the project area , a gopher tortoise relocation permit must be obtained <br /> from the FWC and the gopher tortoise( s ) relocated prior to the initiation of construction <br /> activities . <br /> The Contractor shall provide the results of the gopher tortoise burrow survey to the <br /> County within 10 days of completion of the survey . If a gopher tortoise relocation permit <br /> is required , the Contractor shall submit a copy of the permit to the County prior to <br /> initiating construction activities . <br /> NOTE : All Potentially Occupied gopher tortoise burrows are protected ( 68A - 27 . 004 <br /> F . A . C ) and must not be impacted without a permit from the FWC . The FWC has <br /> determined that if a 2546ot radius surrounding the burrow is protected from disturbance <br /> 01060 - 1 <br />
