Article 10 . ROYALTIES AND PATENTS <br /> The Contractor shall pay all royalties and license fees . He shall defend all suits or claims for <br /> infringement of any patent rights and shall save the Owner harmless from loss on account thereof <br /> except that the Owner shall be responsible for all such loss when a particular process or the <br /> product of a particular manufacturer or manufacturers is specified, unless the Owner has notified <br /> the Contractor prior to the signing of the contract or included in the specifications a provision that <br /> there may be a patented process or product included in the project . <br /> Article 11 . SURVEYS PERMITS AND REGULATIONS <br /> The Owner will provide a boundary surrey " sketch " depicting all property lines , right-of-way lines , <br /> easements , etc . , with monumentation , permanent reference points , and bench mark locations <br /> depicted . <br /> Permits and licenses necessary for the execution of the work shall be secured and paid for by the <br /> Contractor . Except those permits listed and included within these documents under the section <br /> titled " Regulatory Requirements and Notification/Construction Permits . " Easements for permanent <br /> structures or permanent changes in existing facilities will be secured and paid for by the Owner <br /> unless otherwise specified . <br /> The Contractor shall give all notices and comply with all laws , ordinances , rules and regulations <br /> bearing on the conduct of the work as drawn and specified . If the Contractor observes that the <br /> drawings and specifications are at variance therewith , he shall notify the Engineer in writing and <br /> any necessary changes shall be adjusted as provided in the contract for changes in the work . If <br /> the Contractor performs any work knowing it to be contrary to such laws , ordinances , rules and <br /> regulations and without such notice to the Engineer, he shall bear all costs arising therefrom . <br /> Article 12 . SAFETY AND PROTECTION ; EMERGENCIES <br /> The Contractor shall take all necessary precautions for the safety of, and shall provide the <br /> necessary protection to prevent damage , injury or loss to ; all employees on the work and other <br /> persons who may be affected thereby , all the work and all materials or equipment to be <br /> incorporated therein , whether in storage on or off the site , and other property at the site or <br /> adjacent thereto , including trees , shrubs , lawns , walks , pavements , roadway , structures and <br /> utilities not designated for removal , relocation or replacement in the course of construction . <br /> He shall comply with all applicable safety and building laws and codes of federal , state , municipal <br /> and other governmental bodies for the safety of persons or property or to protect them from <br /> damage , injury or loss . He shall erect and maintain , as required by the conditions and progress or <br /> the work all necessary safeguards for their safety and protection , including posting danger signs <br /> and other warnings against hazards , promulgating safety regulations and notifying owners of <br /> adjacent utilities . When the use or storage of explosives or other hazardous materials is necessary <br /> for the execution of the work , the Contractor shall exercise the utmost care and shall carry on such <br /> activities under the supervision of licensed specially qualified personnel . All damage , injury or loss <br /> to any such property caused , directly or indirectly , in whole or in part, by the Contractor, any <br /> Subcontractor or anyone directly or indirectly employed by any of them or anyone for whose acts <br /> any of them may be liable , shall be remedied by the Contractor. <br /> In emergencies affecting the safety of persons or the work or property at the site or adjacent <br /> thereto , the Contractor, without special instruction or authorization from the Engineer or Owner, is <br /> obligated to act , at his discretion , to prevent threatened damage , injury or loss .
