7 . PARTIAL PAYMENTS - partial payments calculated from quantities of work performed will <br /> be made on or about the 10th of each month on pay estimates based on the previous <br /> month ' s progress . The Contractor shall , prior to the 25th of the preceding month , submit <br /> invoices for work performed for the previous month . The Engineer will certify all invoices <br /> before presenting them to the Owner for payment . The Engineer' s form of pay estimate <br /> stating that the bill is fair and equitable and in exact accord with the contract prices will be <br /> utilized for pay purposes . Ten percent ( 10 % ) of the amount due and payable to the <br /> Contractor will be retained from each partial payment . Final payment will be accomplished <br /> as prescribed in the Form of Agreement. <br /> 8 , RESTORATION OF DAMAGED PARTS OF THE WORK - It shall be the responsibility of <br /> the Contractor to repair, rebuild or restore to its former condition , any and all portions of <br /> existing utilities , structures , equipment , appurtenances or facilities other than those to be <br /> paid for under the specifications , which may be disturbed or damaged due to his <br /> construction operations . <br /> � 9 . STANDARDS FOR QUALITY AND WORKMANSHIP All work shall be first class and the <br /> finished product equal to the best-accepted standards of the trade and the category of <br /> work performed . <br /> 10 . TESTS - The Engineer shall have the right to require all materials to be submitted to test <br /> prior to incorporation in the work. In some instances , it may be expedient to make these <br /> tests at the source of supply and for this reason , it is required that the Contractor furnish <br /> the Engineer with information concerning the location of his source before incorporating <br /> material in the work . This does not in any way obligate the Engineer to perform tests for <br /> acceptance of material and does not relieve the Contractor of his responsibility to furnish <br /> satisfactory material . The Contractor shall furnish manufacturer' s certificates of compliance <br /> with these specifications , covering manufactured items incorporated in the work . <br /> The Contractor will be responsible for the payment of all required testing , as specified in <br /> the construction plans , including but not limited to : <br /> Density and/or F . B .V . or L . B . R . Tests : on subgrade , base , trench backfill , etc . For the <br /> minimum number of tests specified in the construction plans or these documents . The <br /> engineer shall be given satisfactory test results prior to payment for any items requiring <br /> testing . <br /> Standard Utility Testing : pressure tests , infiltration/exfiltration , T . V. /lamping , Bac- <br /> T/disinfection , etc . as specified by the construction plans and as specified by the local <br /> Utility Department . The Engineer must be present for all utility testing , and must be given <br /> 24-hour notice prior to testing . <br /> - Asphaltic Concrete Surface Course : the owner reserves the right to core sample/test at <br /> anytime . Correct results will be paid for by the owner. Otherwise , the Contractor will be <br /> responsible for the replacement of all defective materials . <br /> 11 . GUARANTY - All materials and the installation thereof which are furnished and installed by <br /> the Contractor under the terms of the contract , shall be guaranteed by the Contractor and <br /> his surety , through the Performance Bond included as a part of the contract documents , <br /> and shall guarantee against faulty workmanship , mechanical and physical defects , leakage , <br /> breakage and other damages and failure , under normal operation , for a period of one ( 1 ) <br /> year from the date of final payment , said date to constitute the commencement of the one <br /> SP-2 - <br />
