rjg <br /> le <br /> ALL <br /> June 5 , 2009 <br /> Jim Sexton <br /> Director of Human Resources <br /> Indian River County BOCC <br /> 1840 25th Street <br /> Vero Beach, FL 32960 <br /> Re : SECOND REQUEST <br /> This is in follow-up to our letter of a few months ago notifying you of a restructuring of our contracts that <br /> is required by Florida law . <br /> As you know, your current contract for the administration of your managed behavioral health benefits <br /> and/or employee assistance program benefits is with UniPsych Benefits of Florida, Inc . ("UniPsych") . <br /> UniPsych is a wholly owned subsidiary of MHNet Specialty Services , LLC (" MHNet") . As a result of <br /> recent conversations with the Florida Office of Insurance Regulation (" OIR") , it has come to our attention <br /> that the Florida OIR interprets Florida' s law to require every entity that has a contract with a client to <br /> process claims on that client ' s behalf must be either licensed as a third party administration ("TPA") or a <br /> licensed insurer or prepaid limited health service organization. Prior to these conversations with the OIR, <br /> MHNet interpreted Florida' s TPA laws to permit an entity , such as UniPsych, to contract with a client to <br /> provide claims administration services as long as one of UniPsych ' s affiliated companies (i . e . , MHNet or <br /> any of its subsidiaries) was either a TPA, an insurer or a prepaid limited health service organization. <br /> As a result of the clarification of the requirements of Florida law, UniPsych must assign its client <br /> contracts to another MHNet entity that satisfies the requirements of Florida law. The entity to whom your <br /> contract will be assigned is MHNet of Florida, Inc . MHNet of Florida is a wholly owned subsidiary of <br /> MHNet and is a licensed prepaid limited health service organization in Florida. MHNet of Florida, as the <br /> assignee , assumes all of the responsibilities and obligations set forth in the current contract you have with <br /> UniPsych and MHNet of Florida will be bound by such terms on and after the effective date of the <br /> assignment . <br /> The assignment of your contract is purely for administrative and legal compliance reasons . This <br /> assignment will in no way change the nature or scope of your relationship with MHNet, nor the people <br /> that manage and administer your account. The communication materials that reflect the UniPsych name <br /> and toll-free telephone number continue to be valid . You will need to make your payments to MHNet of <br /> Florida, Inc .
