<br /> THIS GRANT OF EASEMENT , made and executed this ). Lx) day of
<br /> � 'K 20127 by 2083 S US HIGHWAY 1 , LLC , a Florida limited
<br /> liability company , whose mailing address is 1155 Driftwood Drive , Vero Beach ,
<br /> Florida 32963 , hereinafter called GRANTOR` , to INDIAN RIVER COUNTY , a
<br /> political subdivision of the State of Florida , having a mailing address of 1801
<br /> 27th Street , Vero Beach , Florida 32960 , hereinafter called GRANTEE * .
<br /> " Whenever used herein , the term GRANTOR and GRANTEE include all parties to this
<br /> instrument and its legal representatives , successors , and assigns .
<br /> WITNESSETH :
<br /> That GRANTOR for and in consideration of the sum of TEN DOLLARS
<br /> ( 310 . 00 ) and other valuable consideration , receipt of which is hereby
<br /> acknowledged by these presents does grant , bargain , sell , alien , remise , release ,
<br /> convey , and confirm unto the GRANTEE , an easement for such period of time as
<br /> it may use same or until the use thereof is abandoned by recorded instrument ,
<br /> for utility purposes over , across , and beneath the following described land ,
<br /> situate in Indian River County , Florida , to -wit :
<br /> See Exhibit " A " attached hereto .
<br /> By use of this easement , GRANTEE acknowledges and agrees that it
<br /> shall be responsible for removing , repairing or replacing at its own cost and
<br /> expense , any landscaping , pavement , fencing or other improvements placed by
<br /> GRANTOR , or its successors or assigns , in this easement which is damaged or
<br /> destroyed by GRANTEE through use of this easement . GRANTEE further
<br /> acknowledges and agrees that GRANTOR , and its successors and assigns , is ,
<br /> and will be , permitted to use the easement area granted herein for parking ,
<br /> ingress and egress purposes so long as such use is consistent with the
<br /> applicable general building , developmental and use codes and regulations for
<br /> the property in which the easement is located .
