Northeasterly around said curve a distance of <br />166.95..feet to the point of tangency; thence run <br />North 74041130" East a distance of 287.89 feet, <br />more or less to the `Pest right-of-way of the <br />present four laned U. S. Highway No. 1 and point <br />of ending. <br />which said property for identification purposes is referred to <br />as the "New Road"; and, <br />WHEREAS, the parties hereto do desire to make certain <br />agreements, covenants and conditions concerning the said Old Road <br />and the said New Road. <br />NOW, THEREFORE, in consideration of the sum of $10.00 and <br />other valuable consideration, as well as the mutual covenants <br />as hereinafter contained, the parties hereto do hereby covenant <br />and agree as follows; <br />1. That the County will abandon, or has abandoned the Old <br />Road as hereinabove set out, and that the same shall cease to be <br />a public road and public right-of-way over that portion thereof <br />which is described above as the "Old Road". <br />2. That the Medical Center, will by a good and sufficient <br />deed convey to the County the New Road right-of-way according <br />to the description thereof as hereinbefore set out and identified <br />as the New Road, and in addition thereto, will provide the County <br />with the certificate of an abstractor licensed to do business in <br />:Indian River County that the said New Road right-of-way is <br />unencumbered and that the grantor of the deed is the record title <br />holder of the said lands. <br />3. That the Medical Center will pave that portion of the <br />New Road hereinabove described according to the standards for <br />road construction as set forth in the presently existing plat filing <br />regulations for Indian River County, Florida. <br />4.
