ORDINANCE NO, 88-27 <br />6/2/88 <br />Jeff <br />LR -Planning <br />DCN/vj <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />SECTION 25. GENERAL PROVISIONS, OF APPENDIX A OF THE CODE OF <br />LAWS AND ORDINANCES OF INDIAN RIVER COUNTY, KNOWN AS THE <br />ZONING CODE, ELIMINATING MONUMENTS FROM THOSE USES <br />CONSIDERED TO BE EXCEPTIONS FROM ZONING DISTRICT HEIGHT <br />LIMITATIONS, AND PROVIDING FOR REPEAL OF CONFLICTING <br />PROVISIONS, CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE, <br />BE IT ORDAINED by the Board of County Commissioners of Indian <br />River County, Florida, that: <br />SECTION 1 <br />Section 25. (a) (1) is hereby amended as follows: <br />Section 25. General Provisions <br />(a) Height exceptions and limitations <br />(1) Height exceptions. The height limitations <br />stipulated in the applicable districts shall not <br />apply to the following, provided that no such <br />structure exceeds the height limits for airport <br />approach areas, as established in paragraph (2). <br />below: <br />Church steeples and spires $49 ;6954,AhOriit <br />Chimneys; <br />Flag Poles; <br />Silos; <br />Elevator Towers; <br />Air Conditioning and Condensing units; <br />Windmills; <br />Aircraft control towers and navigational <br />aids; <br />Utility transmission towers; <br />Solar energy collectors; and <br />Similar structures. <br />Notwithstanding, any radio, television or <br />microwave transmission tower which is greater than <br />one hundred forty (140) feet in height shall only <br />be allowed subject to criteria established for <br />such towers in $¢¢t Ori Sec. 25 X.AY.1 (s) (3). <br />All previous ordinances, resolutions, or motions of the Board <br />of County Commissioners or Indian River County, Florida which <br />conflict with the provisions of this ordinance are hereby repealed <br />to the extent of such conflict. All Special Acts of the <br />legislature applying only to the unincorporated portion of Indian <br />River County and which conflict with the provisions of this_ <br />ordinance are hereby repealed to the extent of such conflict. <br />Coding: Words in fl4tlA type are deletions from existing <br />law.
