6/2/86 <br />Rich3 <br />LR -Planning <br />RS/h <br />ORDINANCE NO. 86- 48 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />SECTION 18 (A).2 CN: NEIGHBORHOOD COMMERCIAL DISTRICT OF <br />APPENDIX A OF THE CODE OF LAWS AND ORDINANCES', KNOWN AS <br />THE ZONING CODE, PROVIDING FOR REVISED PROCEDURES FOR <br />TERMINATING NEIGHBORHOOD COMMERCIAL NODES; AND PROVIDING <br />FOR REPEAL OF CONFLICTING PROVISIONS, CODIFICATION, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida, that: <br />Section 18 (A) .2 "CN: Neighborhood Commercial District" <br />shall be amended as follows: <br />$0¢l/X0/,AY/l Sec. 18.2 CN: Neighborhood Commercial District. <br />(b) (5) f. Termination of neighborhood node approval. jkXX The <br />Board of County Commissioners may terminate neighborhood node <br />approvalsMXX/►�i/�u�/}��/uiXX/�¢�/ted if construction <br />has not commenced, as defined in Section 23.1 (g) (1), within <br />eighteen (18) months of the date of approval. In addition, <br />neighborhood node approval 4X441 may be. terminated by the County <br />Commission upon abandonment of construction, as defined in Section <br />23.1 (g) (3). The approval date shall be the effective date of <br />the ordinance which rezoned the property to CN. Eighteen (18) <br />months after a neighborhood node is established by rezoning <br />property to CN, the Planning and Development Division shall <br />schedule a public hearing before the Board of County Commissioners <br />to make a progress report on the development of the node. The <br />progress report will indicate whether or not a site plan has been <br />submitted or approved and whether or not a building permit has <br />been issued and maintained for the property. Moreover, the report <br />will indicate whether or not there has been interest from other <br />developers concerning developing neighborhood nodes in the area. <br />After the public hearing, the Board will decide whether to <br />terminate the node approval or extend approval for six (6) months. <br />If the Board decides to terminate the node approval, the planning <br />staff shall initiate a rezoning request to down -zone the property <br />to an appropriate residential zoning district. <br />CODING: words in $ttoog t4tO type are deletions from existing law. <br />Words underlined are additions. <br />
