ably utilize any base flood elevation and floodway data available <br />from a Federal, State, or other source, as criteria for requiring <br />that new construction, substantial improvements, or other develop- <br />ment in Zone A comply with the standards for flood protection set <br />forth in this ordinance, however, in no case shall such develop- <br />ment within Zone A be less than eighteen (18) inches above the <br />crown of the road or elevation required by the Indian River County <br />Health Department, <br />SECTION 7 B. Stormwater Management and Flood Protection <br />Permit (Type B). <br />When a development project is determined to be within a Flood <br />Hazard Zone according to the procedure set forth in Section 7 A <br />(19) (a -f), a Type B Permit shall be required and the project <br />shall be reviewed under the criteria of Section 7 (A) and must <br />meet the following additional criteria, <br />(1) Except for those development projects within the <br />100 -year flood.plain along the Indian River, an equal volume of <br />storage capacity must be created for any volume of the regulatory <br />flood that would be displaced by fill or structures. For those <br />development projects within the 100 -year flood plain of the Indian <br />River, an equal volume of storage capacity must be created for any <br />volume of the regulatory flood that would be displaced by fill or <br />structures below elevation 4.0 ft. NGVD or the 10 -year Flood <br />elevation which has been determined by FEMA, whichever is greater. <br />Provided, however, that the Board of County Commissioners may, in <br />its discretion, grant a waiver from the provisions of this <br />subsection upon the affirmative showing of the applicant, by means <br />of a competent engineering study, that the development project is <br />situated in an estuarine environment and that the development <br />project, as designed, will meet all other requirements of the <br />Stormwater Management and Flood Protection Ordinance and will not <br />create a material adverse impact on flood protection on other <br />lands in the estuarine environment. <br />(2) The velocity of the regulatory flood must not be <br />adversely altered on any watercourse. <br />(3) All structures, including buried storage tanks, must be <br />anchored as necessary to resist flotation, lateral forces and the <br />impact of floating debris. <br />(4) No development will be allowed that poses a significant <br />threat of releasing harmful quantities of pollutants to surface <br />waters or groundwaters during flooding. <br />(5) The Flood Protection Elevation shall be set for each <br />project at the elevation of the regulatory flood. �X0$/6fA//f6kVE/. <br />In Coastal High Hazard Zones, the Flood Protection Elevation shall <br />be established with consideration given to wind -drive wave action. <br />All construction within the Indian River County Coastal Zone shall <br />be in compliance with the County's current Coastal Construction <br />Code. <br />
