F3 <br />(3) A statement specifying the nature of the violation. <br />(4) A description of the remedial actions necessary to <br />bring the development activity into compliance and a time schedule <br />for completion of such remedial action. <br />(5) A statement of the penalty or penalties that may be <br />assessed against the person to whom the notice of violation is <br />directed. <br />(6) A statement that the Community Development Direc- <br />tor's determination of violation may be appealed to the Board of <br />Adjustments by filing a written notice of appeal within thirty <br />(30) days of service of notice of violation. <br />Be The notice of violation shall be served upon the <br />person(s) to whom it is directed either personally, in the manner <br />provided for personal service of notices by the court of local <br />jurisdiction, or by mailing a copy of the notice of violation by <br />certified mail, postage prepaid, return receipt requested to such <br />person at his or, her last known address. <br />SECTION 14 ENFORCEMENT <br />A. Any violation of this ordinance is a public nuisance and <br />may be restained by injunction or otherwise abated in a manner <br />Provided by law. <br />Be In addition to or as an alternative to any penalty <br />provided herein or by law, any person who violates the provisions <br />of this ordinance shall be punished by a fine of not more than <br />FIVE HUNDRED DOLLARS ($500.00) or by imprisonment in the county <br />jai for a period not to exceed sixty (60) days, or by both such <br />fin and imprisonment. Such person shall be guilty of a separate <br />offense for each day during which%the violation occurs and con- <br />tinues. <br />C. Any violator may be required to restore land to its <br />undisturbed condition. In the event that restoration is not <br />undertaken within a reasonable time after notice, the County may <br />take necessary corrective action, the cost of which shall become a <br />lien upon the property until paid. <br />SECTION 15. VESTED RIGHTS <br />This ordinance shall not limit the vested rights of any <br />person to complete any development project for which approval was <br />properly granted based upon prior law, where such previous approv- <br />al remains in effect. The County Commission may acknowledge <br />vested rights in other circumstances where it is equitable and <br />just. <br />SECTION 16. CONFLICT WITH OTHER ORDINANCES AND CODES <br />In case of a conflict between the provisions of this ordi- <br />nance and prior ordinances, the prior ordinance shall be deemed <br />repealed to the extent of such conflict. Indian River County <br />Ordinance 78-25, as amended and codified, and Section 23 (k) of <br />the Indian River County Zoning Code, pertaining to flood protec- <br />tion and stormwater management control and criteria respectively, <br />are hereby expressly repealed. <br />
