ORDINANCE NO. 88 - 10 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR <br />THE PROPERTY DESCRIBED HEREIN, AND PROVIDING FOR <br />EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request, and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />ALL OF GOVERNMENT LOTS 2,3,4,5, AND 8 AND THOSE PORTIONS <br />OF GOVERNMENT LOT 1 AND GOVERNMENT LOT 6 LYING WEST OF <br />S.R. A -1-A RIGHT-OF-WAY LYING WITHIN SECTION 15, <br />TOWNSHIP 31 SOUTH, RANGE 39 EAST, OF INDIAN RIVER <br />COUNTY, LESS THE S.R. A -1-A RIGHT-OF-WAY. <br />Be changed from A-1 Agricultural District, to RS -3, Single -Family <br />Residential District. <br />Situated within the above described property exists 16.6 acres, <br />more or less, of Environmentally sensitive land (see attached <br />survey).
