ORDINANCE NO. 87-55 <br />9/2/87 <br />pnot2 <br />LR -Planning <br />DN/vh <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP <br />FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />Being a parcel of land situated in the northwest $ of <br />Section 28, Township 31 South, Range 39 East, Indian River <br />County, Florida, and more particularly described by metes <br />and bounds as follows: Commence at the southwest corner of <br />Government Lot 5, Section 21, Township 31 South, Range 39 <br />East, thence run south on the west boundary line of the <br />northeast $ of the northwest J of Section 28, a distance of <br />38.28 feet to a point of intersection of said west boundary <br />line with the east right-of-way line of U.S. Highway No. 1; <br />thence run south 25°57144" east along the east boundary line <br />of U.S. Highway No. 1 a distance of 225.97 feet to the Point <br />of Beginning, which is the intersection of the east boundary <br />of U.S. Highway No. 1 and the south boundary line of SRD 70 <br />foot drainage easement as recorded in Official Record Book <br />5, Page 297, Indian River County records. From said Point <br />of Beginning run north 44°3116" east along the south line of <br />the SRD drainage easement a distance of 285.27 feet to a <br />point; thence continue along south line of SRD drainage <br />easement North 64°24'31" East a distance of 31.90 feet to a <br />point; thence, run south 25°57'44" east a distance of 586.39 <br />feet to a point; thence south 63150116" west a distance of <br />300.05 feet to the east boundary line of U.S. Highway No. 1; <br />thence north 25157'44" west a distance of 490.15 feet to the <br />Point of Beginning. <br />Be changed from CL, Limited Commercial District to CG, General <br />Commercial District. <br />
