a <br />ORDINANCE NO. 86- 34 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP <br />FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />THAT PART OF THE SOUTH 210 FEET OF THE SOUTHEAST QUARTER OF <br />THE SOUTHWEST QUARTER OF SECTION 31 TOWNSHIP 32 SOUTH, RANGE <br />39 EAST LYING WEST OF U.S. HIGHWAY 1 AND EAST OF OLD DIXIE <br />HIGHWAY LESS THE RIGHT-OF-WAY FOR 69th STREET AND LESS THE <br />FOLLOWING DESCRIBED PARCEL <br />From the Southeast corner of the southwest A of section <br />3-32-39, run North 88148110" West 78.05 feet, thence 1111'50" <br />East 50 feet, thence North 88148110" West 176.83 feet to the <br />point of beginning, thence North 88148110" West 186.0 feet to <br />PC of curve to right, thence along said curve having a radius <br />of 25.0 feet and a central angle of 73128'48" an arc distance <br />of 32.06 feet to point on Easterly right-of-way line of Old <br />Dixie Highway, thence turn Northwesterly along easterly <br />right-of-way of Old Dixie Highway and along a curve having a <br />radius of 5662.0 feet and a central angle of 1118'19" an arc <br />distance of 128.0 feet, thence South 88045139" East 247. 76, <br />thence South 1°11'50" West 140 feet to point of beginning. <br />Be changed from RM -6, Multiple -Family Residential District, to CH, <br />Heavy Commercial District. <br />All with the meaning and intent and as set forth and <br />described in said Zoning Regulations. <br />
