r <br />ON POTION BY COMMISSIONER HASSEY, SECONDED BY COMMISSIONER LOY, ? <br />THE CHAIRMAN VOTED IN FAVOR AND THE FOLLOWING UTILITIES FRANCHISE <br />REQUIREMENTS, .AS PRESENTED BY JAMES BEINDORF CONSULTING ENGINEER, WAS <br />ADOPTED. <br />UTILITIES FRANCHISE <br />The following items must be provided to the County <br />Administrator at the time of making application for a <br />utilities franchise: <br />1. Name and address of applicant. <br />2. The franchise shall specify the legal description <br />of the area to be served by the system and whether the <br />franchise is to be exclusive or non-exclusive for that <br />area. <br />3. The franchise shall specify whether it is for a <br />public water system, a,public sewerage system, or both, <br />and the Commission may require a franchise holder of <br />either a public water system or a public sewerage system, <br />or both, to provide installation, pipes, lines, extension, <br />main and lateral for both systems so that one system will <br />I <br />not be extended without the other system being extended <br />at the same time. <br />4. The franchise shall require that the system be <br />approved by the Department of Health and Rehabilitative <br />Services, Division of Health, The Department of Pollution <br />Control and appropriate planning agencies relative to <br />construction, design, operation, capacity, maintenance and <br />expansion. <br />5. Before the issuance of a franchise, a public <br />hearing shall be held, the notice of such hearing, the <br />name of the applicant, the legal description of the area <br />to be embraced by the franchise, the proposed rate and <br />hookup charges, the period for which the franchise is <br />required and the time and place of such hearing shall be <br />published in a newspaper regularly published in said <br />County at least one time, not more than one month, nor less <br />8n0� �� PAGE <br />OCT 111972 <br />A <br />
