ORDINANCE NO. 86- 21 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER. COUNTY, FLORIDA ESTABLISHING A COASTAL <br />CONSTRUCTION BUILDING ZONE BOUNDARY 5,000 FEET LANDWARD <br />OF THE COASTAL CONSTRUCTION CONTROL LINE LOCATED IN THE <br />UNINCORPORATED PORTION OF THE BARRIER ISLAND IN INDIAN <br />RIVER COUNTY, FLORIDA, ESTABLISHING MINIMUM STANDARDS <br />FOR THE DESIGN AND CONSTRUCTION OF BUILDINGS AND <br />STRUCTURES ON, THE COASTAL •BARRIER ISLAND .AND IN THE <br />COASTAL BUILDINGY ZONE; PROVIDING FOR INCORPORATION IN <br />CODE, SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, it `is the express intent of the Florida <br />Legislature and of the Board of County Commissioners of Indian <br />River County that the sensitive portions of the coastal area shall <br />be managed through .the imposition of strict construction <br />standards; and <br />WHEREAS, the Coastal Zone Protection Act of 1985 [Sections <br />161.52-161.58, Florida Statutes (1985)] requires all local <br />governments with jurisdictions fronting the Gulf of Mexico, <br />Atlantic Ocean, Florida Bay, or Straits of Florida to establish <br />certain minimum construction standards applicable to the "Coastal <br />Building Zone" and the coastal barrier islands; and <br />WHEREAS, within this designated zone increased minimum <br />standards for construction of major habitable structures will <br />apply: <br />NOW, THEREFORE BE IT ORDAINED BY INDIAN RIVER COUNTY BOARD <br />OF COUNTY COMMISSIONERS that: <br />The provisions contained herein shall constitute the Coastal <br />Construction Code for construction within the coastal building <br />zone in Indian River County and shall be referred to as the <br />"Coastal Code." <br />The Board of County Commissioners has authority to <br />adopt this ordinance through its general non -charter county powers <br />pursuant to. Article VIII of the Florida Constitution and Chapters <br />125, 161, 163, 252.38, and 380 of the Florida Statutes, and all <br />other applicable laws of the State of Florida. <br />The purpose of the Coastal Code is to provide minimum <br />standards for the design and construction of buildings and <br />structures other than coastal protective structures and to reduce <br />the harmful effects of hurricanes and other natural disasters <br />occurring along the coastal areas of Indian River County. The <br />Coastal Code is site specific to the coastal building zone as <br />defined herein and is not applicable to other locations. In the <br />event of a conflict between this Article and other articles or <br />chapters of this Code, the requirements resulting in more <br />restrictive design shall apply. No provisions in this Article <br />shall be construed to permit any construction in any area <br />prohibited by local city, county or state regulation. <br />
