M 1900 <br />VERO iUCH, FLORIDA <br />11960 <br />This Agreement made and entered into this C� day of <br />1972, by and between the CITY OF VERO BEACH, a munici- <br />pal corporation of the State of.Florida, Party of the First Part, <br />and THE ROCK RIDGE SUBDIVISION STREET LIGHTING DISTRICT, a <br />special taxing district existing under the laws of the State of <br />Florida and located in Indian River County, Florida, Party of <br />the Second Part; <br />WITNESSETH: <br />WHEREAS, Party of the Second Part has requested the Party <br />of the First Part to furnish street lighting in connection with <br />certain streets existing within the*territortal boundaries of th <br />Party of the Second Part, and <br />WHEREAS, the Party of the First Part is willing to furnish <br />such street lighting upon the terms and conditions agreed upon <br />between the parties, now, therefore; <br />L. The Party of the First Part will install lighting <br />fixtures at the places and locations as designated by the Party <br />of the Second Part, at a cost not to exceed $192.60 per unit. <br />If the Party of the Second Part requires.any installation that <br />exceeds this amount, the same will be paid for by the Party of <br />the Second Part. <br />2. The Party of the First Part will perform routine <br />maintenance of the lighting fixtures so located, such as lamp <br />and refractor replacements, but the Party of the Second Part <br />will supply the lamps and refractors and will reimburse the Party <br />of the First Part for major materials used, such as poles and <br />related pole/line hardware. <br />3. The Party of the First Part will replace the presently <br />located timer -control with a master photocell on the existing <br />system. -14- <br />y ,' <br />ii <br />
