].]./23/93(cl c \ckiapt 103_ ord> Ow <br />ORDINANCE 9; 4 03 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />AMENDING CHAPTER 103, COMMISSIONS AND <br />BOARDS, OF THE CODE OF INDIAN RIVER <br />COUNTY, TO IMPLEMENT SECTION 112.3143(5)t <br />F.S. , CONCERNING VOTING CONFLICTS AND TO <br />REMOVE j THE APPEARANCE OF IMPROPRIETY BY <br />COMMISSION, BOARD OR COMMMITTEE MEMBERS <br />CONCERNING VOTING CONFLICTS. <br />WHEREAS, Section 112.3143 (5) , F.S. directs the governing <br />body when appointing a member to a commission, board or committee to <br />consider the number and notice of previous voting conflicts; and <br />WHEREAS, from time to time members of commissions, boards, <br />and committees after having declared a conflict have appeared before <br />the commission, board or committee of which they are a member and <br />represented their clients interest; and <br />WHEREASi, while said representation is not prohibited by <br />Florida Statutes, it does give an appearance that the public may <br />misconstrue as a lack of propriety; and <br />WHEREAS,, it is equally important not only to do justice but <br />to give the appearance of doing justice, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that. <br />SECTION'i I. AMENDMENT. <br />A new Section 103.04.2 of the Code of Ordinances of Indian <br />River County is added to read as follows <br />Section 103.04.2 Voting Conflicts. <br />(a) This section is supplemental to voting conflict <br />restrictions in the Florida Statutes. <br />(b) Whenever a person is being considered for appointment <br />or reappointment to a commission, board or committee, the <br />Administrative Assistant to the Board shall inform the Board of County <br />Commissioners of the number and nature of the memoranda of conflict <br />previously filed by the person being considered for appointment or <br />I <br />reappointment under Section 112.3143 , F . S . <br />(c) No person who is a member of a commission, board or <br />committee shall appear before that commission, board or committee in a <br />representative capacity. This shall not prohibit said member from <br />appearing before the commission, board or committee in a matter on that <br />member's own behalf. <br />I <br />
