6/15/94 (c11201_dOC�OW <br />I)oe- <br />ORDINANCE 94- 2,1 <br />AN <br />ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING CHAPTER 201 COUNTY <br />WATER AND SEWER SERVICES OF THE INDIAN <br />RIVER COUNTY CODE TO PROVIDE <br />PRETREATMENT REGULATIONS. <br />WHEREAS, it is necessary for public health, safety and welfare to <br />set forth uniform requirements for direct and indirect discharges of <br />pollutants from industrial users into the wastewater collection and <br />treatment system of Indian River County, and <br />WHEREAS, these regulations enable the County to comply with <br />applicable State and Federal laws including the Clean Water Act (33 USC <br />1251, et. seg.) and the General Pretreatment Regulation (40 CFR Part <br />403), <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. CONSEQUENTIAL AMENDMENT T. <br />Section 201.08 is amended by the addition of a new subparagraph <br />to read as follows: <br />N. Pretreatment Fees. <br />1) Industrial users who are required to obtain an industrial discharge <br />permit pursuant to Part III of this chapter shall pay an initial <br />application fee of $150.00 and an annual fee of $100.00. <br />2) Industrial users who are required to submit monitoring reports <br />pursuant to Part III of this chapter shall be assessed a late fee of <br />$50.00 for each incidence of failure to submit a monitoring report within <br />60 days of the designated monitoring date. <br />SECTION 2. PRETREATMENT REGULATIONS. <br />Attachment sets forth pretreatment regulations which are <br />hereby adopted and which will not be codified at this time. <br />SECTION 3. CODE AMENDMENT* <br />A new Part III to Chapter 201 is added to read as follows <br />Part III Pretreatment Regulations . <br />Pretreatment regulations for industrial users have been adopted by <br />ordinance. These regulations have not been codified but are in full <br />commissioners <br />the <br />force and effect <br />as if they were <br />included <br />in <br />this code. <br />A copy of <br />regulations may <br />be obtained <br />from the <br />clerk <br />to the <br />board of county <br />commissioners <br />or from the utility <br />department <br />of the county. <br />
