a. The dock is removed within thirty <br />(30) days by the owner to the <br />satisfaction of the county; and <br />b. The owner has received certificate <br />of occupancy on the principal <br />structure; <br />3. Upon determination by the code <br />enforcement board that a violation has <br />occurred, the board shall order the owner <br />to remove the dock and shall prohibit the <br />building of a structure riparian to the <br />land in question for a period of not less <br />than two (2) nor more than five (5) <br />years. The order of the board shall be <br />recorded in the public records of Indian <br />River County, <br />4. The dock shall be constructed on pilings <br />so as not to involve filling or dredging <br />other than necessary to install the <br />pilings, <br />5. The dock shall not substantially impede <br />the flow of water or create a <br />navigational hazard. <br />J. Section 971.21(3) is hereby amended to read as follows: <br />(3) Carry -out restaurants, excluding curb service, <br />drive-in, drive-through and similar type establishments <br />(administrative permit): no Planning and Zoning <br />Commission review or approval required if associated with <br />a site plan reviewed as an administrative approval or <br />minor site plan. <br />(a) Districts requiring administrative permit <br />approval, (pursuant to the provisions of <br />971.04): MED, OCR. <br />The intended purpose for allowing the use is <br />for convenience to serve persons living and <br />working within the MED district, or living and <br />working in or near the OCR district. <br />1. The location and designation for all <br />thoroughfares providing direct and <br />indirect access to the site; <br />2. The location of all hospital emergency <br />entrances or exits within five hundred <br />(500) feet of the site. <br />(c) Criteria for carry -out restaurants and <br />restaurants, excluding curb service, drive-in, <br />drive-through and similar type establishments: <br />1. No site shall be located within five <br />(500) feet of a hospital emergency <br />entrance or exit, <br />2.
