(c) Removal bond required. Prior to the placement of a <br />political sign, or signs, a bond of two hundred <br />fifty dollars ($250.00) or two hundred fifty <br />dollars ($250.00) in cash shall be posted with the <br />community development department. For each <br />violation discovered, $25.00 of the bond amount <br />shall be forfeited to the county up to the total <br />Bond amount ($250.00). For each violation <br />discovered, county code enforcement staff shall <br />record the date, time, location and candidate or <br />campaign involved. The security may be forfeited <br />in whole or in part to the county for any the <br />following reasons: <br />1. Failure to remove all signs within the <br />applicable five (5) day period for removal, <br />2. The placement of signs upon any tree, utility <br />pole, or similar object; <br />3. The placement of any sign without permission <br />of the owner of the property upon which the <br />sign is placed; <br />Placement of a sign in a public or private <br />road right-of-way. For purposes of this <br />regulation, the road right-of-way line shall <br />be deemed to be the edge of sidewalks or <br />utility poles furthest from the road. Where <br />no such structure(s) are present, the right- <br />of-way line shall be deemed to be 20' back <br />from the near edge of roadway pavement or, if <br />unpaved, the near edge of unpaved roadbed <br />surface. <br />The illegal placement of any political sign <br />advertising a particular candidate shall be prima <br />facie evidence that the candidate placed or <br />authorized the placement of said sign. <br />(d) Procedure for waiver of removal bond. Any <br />candidate may apply for a hearing before the board <br />of county commissioners to show cause why he or she <br />is unable to post a bond as required in this <br />section. Upon a showing of good cause, the board <br />of county commissioners may waive the bond <br />requirement. However, any candidate who obtains a <br />waiver of the bond requirement shall not be <br />relieved of the removal requirements herein and <br />shall be responsible to the county for the cost of <br />the county's removing any signs placed in violation <br />of this section. <br />(e) Zoning districts permitted.
