feet (rather than a minimum lot width) frontage <br />requirement, regardless of the zoning district in which <br />the property is located. <br />SECTION 22: Section 954.11 is hereby established to read as <br />follows: <br />_Section 954.11 Security for construction of required paving <br />improvements <br />For projects projected to generate/ attract less than one hundred_ <br />(100) average daily trips, a certificate of occupancy (C.O.) may be <br />issued without construction of required driveway/parking area <br />paving improvements if a contract for construction of required <br />paving improvements has been properly executed and if security has <br />been posted in an amount equal to one hundred fifteen (115) percent <br />of the estimated cost of the required paving improvements* <br />(AA) The contract shall be on a form provided by the county <br />and shall obligate the developer to complete all required <br />paving improvements, in accordance with the approved site <br />plan(s) and county development regulations and standards, <br />within a period of twenty-four months of the date of the <br />C.O. <br />(BZ The estimated cost of paving shall be approved by the <br />county engineer after review of an itemized cost estimate <br />certified by the developer's engineer or review of an <br />actual itemized contract price bid. <br />The surety posted to guarantee performance of the <br />contract shall expire, if at all, no less than ninety <br />(90) days beyond the last date for performance <br />established by the contract. The surety shall run in <br />favor of the board of county commissioners, must be in a <br />form acceptable to the county attorney, and may be <br />either: <br />1. A cash deposit and escrow agreement governing <br />control and use thereof, or <br />2.
