ORDINANCE NO. 99- 13 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA AMENDING THE <br />LAND DEVELOPMENT REGULATIONS (LDRS) CHANGING THE LIST OF <br />PERMITTED USES WITHIN THE MED (MEDICAL) ZONING DISTRICT, AND <br />AMENDING THE FOLLOWING CHAPTERS OF THE LAND DEVELOPMENT <br />REGULATIONS (LDRS): CHAPTER 901, DEFINITIONS; CHAPTER 911, <br />ZONING; CHAPTER 912, SINGLE-FAMILY DEVELOPMENT; CHAPTER 913, <br />SUBDIVISIONS AND PLATS; CHAPTER 917, ACCESSORY USES AND <br />STRUCTURES; CHAPTER 934, EXCAVATION AND MINING; CHAPTER 952, <br />TRAFFIC; AND CHAPTER 971, REGULATIONS FOR SPECIFIC LAND USE <br />CRITERIA; AND PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS, <br />CODIFICATION, SEVERABILITY AND EFFECTIVE DATE, <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA THAT THE INDIAN RIVER COUNTY LAND DEVELOPMENT <br />REGULATIONS (LDRS) BE AMENDED AS FOLLOWS: <br />1. Murphy Deed Reservations: definitions and setback requirements relating to Murphy <br />Deed Reservations. <br />The following definitions of Chapter 901 are hereby modified or established as follows: <br />111. MurphyDeed Reservation • rights reserved by the State of Florida under the 1937 <br />Murphy Act for use of properties for public right-of-way purposes <br />2. Right -of -Way: a strip of land dedicated, deeded, used, or to be used for a street, <br />alley, walkway, boulevard, utility installations, drainage facility, access for ingress or egress, or other <br />purpose by the public, certain designated individuals, or governing bodies. Includes Murphy Deed <br />Reservations. <br />3. Setback: the minimum horizontal distance between the front, rear or side lines of <br />the lot and the front, rear or side lines of the building including porches, carports, and accessory uses <br />subject to yard encroachment provisions of Chapter 911, Zoning. However, front yard setbacks shall <br />be measured from the right -of wayl, which includes Murphy Deed Reservations. For flag lots, <br />the front yard setback shall be measured from the line where the majority of the lot area meets the <br />narrow strip of land that connects the lot to the road. right-of-way. <br />4. Yard, front: on, interior lots the yard being the minimum horizontal distance <br />between the structure and the street right -of --way or Murnhy Deed Reservation line. On multi - <br />frontage lots (including corner lots) all yards which abut a street right -of --way or Murphy Deed <br />Reservatio'are consi <br />ndered front yards, with the following exception: <br />For parcels adjacent to subdivision street rights -of --way, where the parcel is separated from <br />the subdivision street by landscape improvements required by the subdivision ordinance and <br />where the parcel cannot be accessed from the subdivision street, the portion of the parcel <br />adjacent to the right-of-way shall be treated as a side yard where a side yard would exist, and <br />a rear yard where a rear yard would exist, absent the right-of-way. <br />On double frontage lots having frontage on opposite sides of the lot or parcel, the yard <br />abutting the street with the lower functional classification as depicted on the county's <br />thoroughfare plan map shall be the front yard. If both streets have the same functional <br />classification, the yard adjacent to the front lot line having the shortest dimension shall be <br />the front yard. <br />Coding: Words in strip type' are deletions from existing law.
