yl <br />w" <br />46 <br />ORDINANCE 93- 09 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA AMENDING SECTION 100.059 INDIAN <br />RIVER COUNTY CODE TO MAKE THE GENERAL <br />PENALTY PROVISIONS APPLICABLE TO <br />ORDINANCES PRIOR TO CODIFICATION. <br />WHEREAS, the general penalty provisions in section 100.05 <br />specifically apply to code violations; and <br />WHEREAS, a strict interpretation of said section could be that the <br />penalty provisions do not apply to a county ordinance until it appears <br />in the code; and <br />WHEREAS, it is desirable to remove this ambiguity and have the <br />penalty provisions apply to any ordinance upon becoming law, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT . <br />Section 100.05. General penalty; continuing violations is amended <br />by adding a new paragraph 4 to read as follows <br />in the ordinance. <br />SECTION 2. SEVERABILITY. <br />If any section, or if any sentence, paragraph, phrase, or word of <br />this ordinance is for any reason held to be unconstitutional, in- <br />operative, or void, such holding shall not affect the remaining portions <br />of this ordinance, and it shall be construed to have been the legislative <br />intent to pass the ordinance without such unconstitutional, invalid or <br />inoperative part. <br />SECTION 3. EFFECTIVE DATE. <br />This ordinance shall become effective upon becoming law. <br />Approved and adopted by the Board of County Commissioners of <br />Indian River County, Florida, on this 2.1 day of March 1993. <br />This ordinance was advertised in the Vero Beach Press -Journal on <br />the 13 day of .February , 1993, for a public hearing to be held on <br />the 23 day of March , 1993, at which time it was moved for <br />adoption by Commissioner Eggert , seconded by Commissioner <br />Adams and adopted by the following vote: <br />4. The <br />provisions <br />of this <br />section <br />shall <br />apply <br />to any ordinance of <br />Indian <br />River County <br />when it <br />has <br />become <br />law just <br />as if this section were <br />in the ordinance. <br />SECTION 2.
