ATTORNEY BURCH ENTERED THE MEETING AT 9:45 O'CLOCK <br />DEWEY WALKER BROUGHT TO THE ATTENTION OF THE. BOARD A <br />PROBLEM THAT HAS BEEN BROUGHT TO HIS ATTENTION REGARDING PROPERTY <br />THAT IS REZONED WITHOUT THE KNOWLEDGE OR ACCEPTANCE OF THE PROPERTY <br />OWNERI THIS HAPPENED RECENTLY WHERE COMMERCIALLY ZONED PROPERTY <br />WAS REZONED TO RESIDENTAL AND THE OWNER WAS NOT INFORMED OF THE <br />REZONING. THE OWNER THEN PROCEEDED TO SELL HIS PROPERTY AS <br />COMMERCIALLY ZONED PROPERTY. THE NEW OWNER, ROBERT DiBASSfE <br />PURCHASED THIS PROPERTY AS COMMERCIAL PROPERTY AND PLANNED TO BUILD AND <br />OPERATE HIS BUSINESS. HE WAS THEN NOTIFIED THAT HIS PROPERTY WAS <br />REZONED To R-1 RESIDENTAL. MR. DiBASSIE WAS INFORMED BY THE ZONING <br />DEPARTMENT THAT HIS PROPERTY WOULD BE REZONED BACK TO COMMERCIAL. <br />THE ATTORNEY STATED THAT THE ZONING ORDINANCE SHOULD BE <br />AMENDED IN ORDER TO PREVENT REZONING OF PROPERTY WITHOUT THE OWNER'S <br />CONSENT. HE ADVISED THE BOARD THAT HE WILL MEET WITH DEWEY <br />WALKER AND VAL BRENNAN TO DISCUSS THIS FURTHER AND TO PREPARE <br />THE NECESSARY PAPERS, <br />ON MOTION BY COMMISSIONER MASSEY, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY INSTRUCTED THE ATTORNEY TO PREPARE <br />THE NECESSARY LEGAL DOCUMENTS TO HANDLE THIS AMENDMENT AND TO <br />ADVERTISE FOR A PUBLIC HEARING, <br />ON MOTION BY COMMISSIONER BOGOSIAN, SECONDED BY COMMISSIONER <br />MASSEY, THE BOARD UNANIMOUSLY APPROVED THE RELEASE OF EASEMENT <br />AND ADOPTED THE FOLLOWING RESOLUTION. <br />-3- <br />JAN 2 41973 <br />4 <br />
