3/23/ 93(lagal�d.oca(TPO/sb� <br />ORDINANCE 93- 10 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA AMENDING SECTION 307.02 AND <br />ADDING SECTION 307.07.1 CONCERNING <br />PARKING SPACES FOR CERTAIN HANDICAPPED <br />PERSONS. <br />WHEREAS, the Indian River County Code was recently <br />amended by the addition of a new Chapter 307 Traffic; and <br />WHEREAS, the Section 307.02 of said Chapter set forth <br />regulations of public parking spaces for certain handicapped persons; <br />WHEREAS, the regulations in Section 307.02 are `more <br />stringent than Florida Statutes; and <br />WHEREAS, uniformity between the Indian River County <br />Code and Florida Statutes will preclude confusion in the mind of the <br />public, especially for persons from other jurisdictions, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />that <br />SECTION 1. AMENDMENT T. <br />a. Section 307.02 is amended as follows with deletions <br />Section 307.02. Public Parking spaces for certain <br />handicapped persons . <br />No person shall park any vehicle in any designated handicapped <br />parking space located within the unincorporated areas of Indian River <br />County, Florida, or located on County owned or leased property <br />unless such vehicle displays a parking permit issued pursuant to <br />Sections 316.1958 or 320.0848, Florida Statutes or a license plate <br />pursuant to Sections 320.084, 320.0842, 320.0843 or 320.0845, Florida <br />Statutes, and such . vehicle is j oft dtOO4 Jb* transporting a <br />jhi��lb$� person eligible for such parking permit. Any person <br />who is chauffeuring a h4Yidf04 bb 6 disabled person shall be allowed, <br />without need for a parking permit or special license plate, <br />momentary parking in a designated handicapped parking space for the <br />purpose of loading or unloading the handicapped person. <br />bo A new section 307.07.1 is added to read as follows : <br />Section 307.07.1 Disposition of Penalties. <br />Notwithstanding any other section to the contrary, fines <br />collected as a result of issuance of a citation on a County form <br />based solely on a violation of a County ordinance shall not be <br />distributed pursuant to Section 318.21, F.S.
