ORDINANCE NO. 96-14 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM A-1 TO <br />RS -6, FOR THE PROPERTY LOCATED +2,200 FEET WEST OF SR AlA, <br />NORTH OF THE MARBRISA SUBDIVISION, AND DESCRIBED HEREIN, AND <br />PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property, and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />A PARCEL OF LAND BEING A PORTION OF GOVERNMENT LOT 1, <br />SECTION 35, TOWNSHIP 31 SOUTH, RANGE 39 EAST, INDIAN <br />RIVER COUNTY, FLORIDA DESCRIBED AS FOLLOWS: <br />COMMENCE AT THE NORTHEAST CORNER OF SAID SECTION 35; THENCE <br />SOUTH 00030107" WEST ALONG THE EAST LINE OF SAID SECTION, A <br />DISTANCE OF 60.00 FEET TO THE POINT OF BEGINNING, THENCE <br />CONTINUE SOUTH 00030'07" WEST ALONG SAID SECTION LINE, A <br />DISTANCE OF 1235.51 FEET, THENCE NORTH 89041'51" WEST, A <br />DISTANCE OF 299.58 FEET TO A POINT ON A LINE WHICH IS 1445.00 <br />FEET WEST OF, AS MEASURED AT RIGHT ANGLES TO, THE EAST LINE OF <br />GOVERNMENT LOT 2, SECTION 36, TOWNSHIP 31 SOUTH, RANGE 39 <br />EAST, INDIAN RIVER COUNTY, FLORIDA; THENCE NORTH 01011'20" <br />EAST PARALLEL TO SAID EAST LINE, A DISTANCE OF 1235.65 FEET TO <br />A POINT ON A LINE WHICH IS 60.00 FEET SOUTH OF, AS MEASURED AT <br />RIGHT ANGLES TO, THE NORTH LINE OF SECTION 35; THENCE SOUTH <br />89041152" EAST ALONG SAID LINE, A DISTANCE OF 284.77 FEET TO <br />THE POINT OF BEGINNING. <br />CONTAINING 8.2869 ACRES MORE OR LESS. <br />Be changed from A-1 to RS -6. <br />All with the <br />meaning <br />and intent <br />and <br />as set forth <br />and described <br />in <br />said Land Development <br />Regulations. <br />
