ORDINANCE N0. 93-5 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM <br />CL AND CG TO PD FOR APPROXIMATELY 32.58 ACRES OF LAND <br />GENERALLY LOCATED BETWEEN STATE ROAD 60 AND THE MAIN <br />RELIEF CANAL, EAST OF 58TH AVENUE; AND DESCRIBED HEREIN, <br />AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request, and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined that <br />this rezoning is consistent with the Comprehensive Plan of Indian <br />River County, and the county land development regulations, <br />including but not limited to the Planned Development (PD) Process <br />and Standards for Development chapter; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, in conjunction with the rezoning request has approved a PD <br />conceptual plan (see EXHIBIT B, attached) that controls and <br />regulates development on the subject land; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the property situated in Indian River County, and legally described <br />in EXHIBIT A (attached) be changed from CL and CG to PD. <br />All with the meaning and intent as set forth in the land <br />development regulations, and the approved conceptual plan as maybe <br />amended pursuant to the provisions of the Planned Development (PD) <br />Process and Standards for Development chapter of the land <br />development regulations. <br />
