ORDINANCE NO. 97-02
<br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE
<br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CL TO
<br />CG, FOR THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF 27TH
<br />AVENUE AND OSLO ROAD (9TH STREET, SOUTHWEST), AND DESCRIBED
<br />HEREIN, AND PROVIDING FOR EFFECTIVE DATE.
<br />WHEREAS, the Planning and Zoning Commission, sitting as the
<br />local planning agency on such matters, has held a public hearing
<br />and subsequently made a recommendation regarding this rezoning
<br />request; and
<br />WHEREAS, the Board of County Commissioners of Indian River
<br />County, Florida, did publish its Notice of Intent to rezone the
<br />hereinafter described property; and
<br />WHEREAS, the Board of County Commissioners has determined that
<br />this rezoning is in conformance with the Comprehensive Plan of
<br />Indian River County; and
<br />WHEREAS, the Board of County Commissioners has held a public
<br />hearing pursuant to this rezoning request, at which parties in
<br />interest and citizens were heard;
<br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County
<br />Commissioners of Indian River County, Florida, that the zoning of
<br />the following described property situated in Indian River County,
<br />Florida, to -wit:
<br />PARCEL l:
<br />COMMENCING AT THE SOUTHEAST CORNER OF TRACT, 16, SECTION 22,
<br />TOWNSHIP 33 SOUTH, RANGE 39 EAST, ACCORDING TO THE PLAT OF
<br />INDIAN RIVER FARMS COMPANY, WHICH SAID PLAT WAS FILED MARCH
<br />23, 1915 AND RECORDED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS
<br />OF ST. LUCIE COUNTY, FLORIDA, THENCE RUN NORTH ON THE EAST
<br />BOUNDARY LINE OF SAID TRACT 16, 297 FEET TO THE POINT OF
<br />BEGINNING, THENCE RUN NORTH ON THE EAST BOUNDARY LINE OF SAID
<br />TRACT 16, 297 FEET, THENCE RUND WEST PARALLEL TO THE SOUTH
<br />BOUNDARY LINE OF SAID TRACT 16, 330 FEET, THENCE RUN SOUTH
<br />PARALLEL TO THE EAST BOUNDARY LINE OF SAID TRACT 16, 297 FEET,
<br />THENCE RUN EAST 330 FEET TO THE POINT OF BEGINNING, AND
<br />PARCEL 2:
<br />BEGINNING AT THE SOUTHEAST CORNER OF TRACT 16, SECTION 22,
<br />TOWNSHIP 33 SOUTH, RANGE 39 EAST, AND RUN NORTH ON THE EAST
<br />LINE OF SAID TRACT 16, A DISTANCE OF 297 FEET, THENCE RUN WEST
<br />A DISTANCE OF 330 FEET, THENCE SOUTH ON A LINE PARALLEL TO THE
<br />EAST LINE OF SAID TRACT 16 TO THE SOUTH LINE OF TRACT 16,
<br />THENCE EAST ON THE SOUTH LINE OF TRACT 16 TO THE POINT OF
<br />BEGINNING SAID LANDS NOW LYING AND BEING IN INDIAN RIVER
<br />COUNTY, FLORIDA; AND
