ORDINANCE NO. 94-14 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />;ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM MED TO <br />OCR, FOR THE PROPERTY LOCATED ON THE NORTH SIDE OF 37TH <br />STREET, APPROXIMATELY 167 FEET WEST OF THE INTERSECTION OF <br />37TH STREET AND INDIAN RIVER BOULEVARD, AND DESCRIBED HEREIN, <br />AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property, and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />A PARCEL OF LAND LYING IN SECTION 25, TOWNSHIP 32 SOUTH, RANGE <br />39 EAST, INDIAN RIVER COUNTY, FLORIDA DESCRIBED AS FOLLOWS: <br />BEGIN AT THE INTERSECTION OF THE NORTH -SOUTH QUARTER SECTION <br />LINE OF SAID SECTION 25 AND THE NORTH RIGHT-OF-WAY LINE OF <br />37TH STREET (A 110.00 FOOT RIGHT-OF-WAY); THENCE N OOo01'22" <br />W, ALONG SAID QUARTER SECTION LINE, A DISTANCE OF 608.13 FEET, <br />THENCE N 89042'39" E, A DISTANCE OF 248.57 FEET, TO THE <br />SOUTHWESTERLY RIGHT-OF-WAY LINE OF INDIAN RIVER BOULEVARD (A <br />200.00 FOOT RIGHT-OF-WAY); THENCE S 44056'05" E, ALONG SAID <br />RIGHT-OF-WAY LINE, A DISTANCE OF 620.55 FEET; THENCE S <br />OOo01'22" E, A DISTANCE OF 167.00 FEET, TO A POINT ON THE <br />AFOREMENTIONED NORTH RIGHT-OF-WAY LINE OF 37TH STREET; THENCE <br />S 89044'30" W, ALONG SAID RIGHT-OF-WAY LINE, A DISTANCE OF <br />686.69 FEET, TO THE POINT -OF -BEGINNING. <br />CONTAINING 7.369 ACRES, MORE OR LESS. <br />Be changed from MED to OCR. <br />All with the <br />meaning and intent <br />and as set forth and described <br />in <br />County Land <br />Development Regulations. <br />
