GERMAN SUAREZ STATED THAT THE PETITIONERS WHO SIGNED <br />THE PETITION FOR THE 17TH STREET LOCATION OF THE SECOND BRIDGE <br />WOULD LIKE TO THANK THE BOARD FOR THE ACTION TAKEN THIS MORNING. <br />THE ADMINISTRATOR INFORMED THE BOARD OF A LETTER <br />FROM THE INDIAN RIPER COUNTY SCHOOL BOARD REQUESTING THE <br />COUNTY TO PAVE APPROXIMATELY 375 FEET FROM 27TH AVENUE TO THE <br />PRESENT SERVICE ROAD -IN FRONT OF THE CITRUS ELEMENTARY SCHOOL, <br />ON MOTION BY COMMISSIONER DRITENBAS, SECONDED BY <br />COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY APPROVED THE REQUEST <br />FROM THE INDIAN RIVER .COUNTY SCHOOL BOARD AS STATED ABOVE. <br />CHARLES SMITH, ATTORNEY REPRESENTING THE CITIZENS FOR <br />THE 12TH STREET BRIDGE APPEARED AND THE CHAIRMAN INFORMED HIM <br />OF THE BOARD S DECISION TO SUPPORT THE 17TH STREET BRIDGE LOCATION. <br />CHAIRMAN LOY ALSO STATED THAT THE BOARD WOULD BE INTERESTED IN <br />LISTENING TO THE CITIZENS FOR THE 12TH STREET BRIDGE. <br />MR. SMITH STATED THAT THERE ARE THREE MAJOR PROBLEMS <br />INVOLVED IN CONSTRUCTING A BRIDGE AT 17TH STREET. HE LISTED <br />THEM AS: 1. NAVIGATIONAL PROBLEMS 2. DIFFICULTY IN OBTAINING <br />RIGHT-OF-WAY FOR THE BRIDGE APPROACHES AND 3. ENVIRONMENTAL PROBLEMS <br />INVOLVING THE RIO.MAAR ROOKERY. <br />AT THE 12TH STREET SITE, ACCORDING TO MR. SMITH, THERE <br />IS ONLY ONE MAJOR ENVIRONMENTAL PROBLEM AND THAT IS THE AQUATIC <br />PRESERVE. <br />MR. SMITH REQUESTED PAUL D. BURCH, ATTORNEY TO THE <br />BOARD OF COUNTY COMMISSIONERS INVESTIGATE AND REQUEST THE ATTORNEY <br />GENERAL OF FLORIDA TO MAKE A RULING STATING THE LEGAL OPINION <br />REGARDING THE RIO MAR ROOKERY AND THE AQUATIC PRESERVE BEING <br />PROTECTED BY THE FEDERAL GOVERNMENT UNDER A SECTION 4-F PROVISION <br />WHICH PREVENTS LANDS DESIGNED AS PARKS OR WILDLIFE REFUGE FROM BEING <br />CROSSED OR ABUTTED.
