R <br />ORDINANCE NO. 94-11 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RM -6 TO <br />CG, FOR THE PROPERTY LOCATED AT THE SOUTHEAST CORNER OF COUNTY <br />ROAD 510 AND 46TH AVENUE, AND DESCRIBED HEREIN; AND AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM IL <br />AND A-1 TO RM -6, FOR THE PROPERTY LOCATED AT THE SOUTHWEST <br />CORNER OF 79TH STREET AND THE FLORIDA EAST COAST RAILROAD <br />TRACKS, AND' DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE <br />DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />A PARCEL OF LAND LYING IN PARTS OF LOTS 1, 2 AND 15, NARANJA <br />TRACT SHELLMOUND BEACH SUBDIVISION AS RECORDED IN PLAT BOOK 11 <br />PAGE 6, INDIAN RIVER COUNTY PUBLIC RECORDS LYING SOUTH OF <br />COUNTY ROAD 510, AND THAT PART OF EUREKA ECOUNTYS SUBDIVISION <br />AS RECORDED IN PLAT BOOK 11 PAGE 401 INDIAN RIVER COUNTY <br />PUBLIC RECORDS, INCLUDING ALL PARCELS, LOTS, BLOCKS AND <br />ROADWAYS LYING WITHIN GOVERNMENT LOT 61 SECTION 28, TOWNSHIP <br />31 SOUTH, RANGE 39 EAST AND BEING MORE PARTICULARLY DESCRIBED <br />AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF SAID <br />GOVERNMENT LOT 6, SECTION 28, TOWNSHIP 31 SOUTH, RANGE 39 <br />EAST, THENCE RUN NORTH 00054158" WEST A DISTANCE OF 92.49 FEET <br />TO THE POINT OF BEGINNING; THENCE CONTINUE NORTH 00054158" <br />WEST A DISTANCE OF 600.00 FEET TO THE SOUTH RIGHT OF WAY OF <br />COUNTY ROAD 510, THENCE RUN NORTH 44035'32" WEST ALONG SAID <br />RIGHT OF WAY A DISTANCE OF 314.00 FEET TO A POINT OF A CURVE <br />CONCAVE TO THE SOUTHEAST; THENCE CONTINUE ALONG THE ARC OF <br />SAID CURVE HAVING A CENTRAL ANGLE OF 1002613111, A RADIUS OF <br />2824.79 FEET, HAVING A CHORD BEARING OF NORTH 49048947" EAST, <br />AN ARC DISTANCE OF 514.80 FEET TO A POINT ON SAID CURVE; <br />THENCE RUN SOUTH 00054158" EAST A DISTANCE OF 534.42 FEET; <br />THENCE RUN SOUTH 44035'32" WEST A DISTANCE OF 871.92 FEET TO <br />THE POINT OF BEGINNING. <br />
