ORDINANCE N0. 94-02 <br />AN ORDINANCE OF: INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RMH-8 TO <br />RS -61 FOR THE PROPERTY LOCATED ON THE WEST SIDE OF 82ND AVENUE <br />APPROXIMATELY 800 FEET NORTH OF 12TH STREET, AND DESCRIBED <br />HEREIN, AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />Being a portion of Tracts 1,2,7, and 8 in Section 11, Township <br />33 South, Range 38 East, according to the plat of the Indian <br />River Farms Subdivision as recorded in Plat Book 2, Page 25, <br />pbulic records of St. Lucie (now Indian River) County, <br />Florida, and being more particularly described as follows: <br />Commence at the Southwest corner of said Tract 7; thence N <br />00012'55" W. along the West line of said Tract 7, a distance <br />of 1653.75 feet; thence N 89°33103" E a distance of 956.13 <br />feet; to the Point of Beginning of the following described <br />parcel. <br />Thence continue N 89033'03" E a distance of 11.00 feet to the <br />point of intersection with a non -tangent curve concave to the <br />East having a radius of 485.00 feet, the chord of which bears <br />S 16022131" E; thence South along the arc of said curve a <br />distance of 182.15 feet through a central angle of 21031'06"; <br />thence N 62051157" E, non -tangent to last described curve, a <br />distance of 387.74 feet, thence N 89033103" E a distance of <br />662.92 feet; thence S 00012113" E a distance of 200.00 feet; <br />thence N 89033103" E a distance of 609.96 feet to the Westerly <br />right-of-way of Ranch Road, said right-of-way line being 30.00 <br />feet west of and parallel with the East line of said Tracts 1 <br />and 8; thence S 00o12113" E, along said West right-of-way <br />line, a distance of 573.51 feet, thence S 89023159" W a <br />distance of 1303.00 feet to the West line of said Tract 8; <br />thence N 0012121" W, along the west line of said Tract 8, a <br />distance of 267.19 feet; thence S 89023159" W a distance of <br />377.01 feet; thence N 00012141" W a distance of 510.75 to the <br />Point of Beginning. <br />Containing 23.99; acres, more or less. <br />
