ORDINANCE NO. 95-05 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RS -1 TO <br />RM -101 FOR THE PROPERTY LOCATED ON THE EAST SIDE OF INDIAN <br />RIVER BOULEVARD, NEAR 8TH STREET, AND DESCRIBED HEREIN, AND <br />PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard, <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />All that part of the North one-half of Government Lot 2, <br />Section 18, Township 33 South, Range 40 East lying East of the <br />East right-of-way of Indian River Boulevard and that part of <br />the North one-half of Government Lot 1, Section 18, Township <br />33 South, Range 40 East being more particularly described as <br />follows: <br />Beginning at the intersection of the North line of the North <br />one-half of Government Lot 2 and the Easterly right-of-way of <br />Indian River Boulevard, run South 89053101" East along said <br />North line a distance of 1,582.54 feet; thence meandering in <br />a Southeasterly direction along the approximate centerline of <br />a dike the following courses; run South 03022'26" East a <br />distance of 145.26 feet; thence run South 00048154" West a <br />distance of 101.46 feet, thence run South 06032119" East a <br />distance of 132.64 feet, thence run South 81o25150" East a <br />distance of 202.75 feet; thence run South 67024'59" East a <br />distance of 67.71 feet, thence run South 40001'44" East a <br />distance of 87.01 feet; thence run South 14054114" East a <br />distance of 170.92 feet to the South line of said North one- <br />half of Government Lot 1; thence run North 89050149" West a <br />distance of 2,045.19 feet to the East right-of-way of said <br />Indian River Boulevard; thence run North 00o18127" East along <br />said right-of-way a distance of 10.67 feet to a point of <br />curvature; thence run Northeasterly along a curve concave to <br />
