DRITENBAS, THE BOARD UNANIMOUSLY AUTHORIZED THE CONSULTING ENGINEERS <br />TO PROCEED WITH FILING APPLICATIONS WITH ENVIRONMENTAL PROTECTION <br />AGENCY, FLORIDA DEPARTMENT OF POLLUTION CONTROL AND/OR FARMERS <br />HOME ADMINISTRATION FOR FUNDING OF THE WATER AND SEWER PROJECT <br />FOR INDIAN RIVER COUNTYK <br />HOMER FLETCHER, TAX ASSESSOR INFORMED THE BOARD THAT <br />THE WEST WABASSO PROGRESSIVE CLUB NEGLECTED TO FILE AN APPLICATION <br />FOR TAX EXEMPTION AND THEY HAVE RECEIVED A TAX BILL FOR APPROXIMATELY <br />$400.00, MR. FLETCHER STATED THAT IF THEY HAD MADE APPLICATION, <br />IT WOULD HAVE QUALIFIED FOR TAX EXEMPTION AND IF THE BOARD APPROVES <br />HE WILL PREPARE THE NECESSARY PAPERS FOR THIS TAX EXEMPTION AND <br />RETURN TO THE NEXT MEETING FOR THE BOARDS APPROVAL. <br />ON MOTION BY COMMISSIONER MASSEY, SECONDED BY COMMISSIONER <br />BO.GOSIAN, THE BOARD UNANIMOUSLY AUTHORIZED HOMER FLETCHER, TAX <br />ASSESSOR, TO PREPARE THE NECESSARY PAPERS FOR TAX EXEMPTION FOR <br />THE WEST WABASSO PROGRESSIVE CLUB. <br />IN 1970, 1971 AND 1972 THE AGRICULTURAL ZONING BOARD <br />DENIED THE APPLICATION FOR AGRICULTURAL ZONING MADE BY ANTHONY A. <br />CORACI. NEWPORT AVENUE REALTY CORP AND CLASSON AVENUE REALTY CORP. <br />AFTER -EACH DENIAL THE ABOVE INDIVIDUAL AND CORPORATIONS FILED SUIT. <br />THE 1970 SUIT HAS BEEN RULED ON BY .JUDGE D.C. SMITH AND THEN BY <br />THE FOURTH DISTRICT COURT OF APPEALS IN FAVOR OF THE ANTHONY A. <br />CORACI, NEWPORT AVENUE REALTY CORP. AND CLASSON AVENUE REALTY CORP, <br />THE COUNTY REFUNDED TAXES FOR THE YEAR 1970 IN THE AMOUNT OF $11,379.39. <br />ATTORNEY BURCH INFORMED THE BOARD THAT SUITS HAVE BEEN <br />FILED WITH THE CIRCUIT COURT FOR 1971 AND 1972 FOR AN AGRICULTURAL <br />ZONING REFUND. ATTORNEY BURCH CONTINUED THAT IN A LETTER FROM <br />THE ATTORNEY OF THE ABOVE NAMED INDIVIDUAL AND CORPORATIONS IT WAS <br />STATED THAT THEY WOULD LIKE TO ELIMINATE GOING TO TRIAL AND REQUESTED <br />THE TAX ASSESSOR AND THE COUNTY COMMISSIONERS TO AUTHORIZE THE <br />REFUND OF THE 1971 AND 1972 TAXES THEY HAVE PAID ON LAND THAT, <br />IN THEIR OPINION, THE COURTS WILL RULE IN THEIR FAVOR THAT THE <br />PROPERTY SHOULD HAVE BEEN ASSESSED AS AGRICULTURAL LAND, <br />COMMISSIONER BOGOSIAN STATED THAT SINCE HOMER FLETCHER <br />-12- <br />eva 17 PA�t ig <br />
