ORDINANCE NO. 98-01 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM RS -1 AND <br />RS -6 TO RM -8, FOR THE PROPERTY LOCATED ON THE NORTH SIDE OF <br />41ST STREET, EAST OF INDIAN RIVER BOULEVARD, AND DESCRIBED <br />HEREIN, AND PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish its Notice of Intent to rezone the <br />hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in' <br />interest and citizens were heard; <br />L <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />THE SOUTHEAST 1/4 OF THE NORTHWEST 1/4 OF SECTION 25, TOWNSHIP <br />32 SOUTH, RANGE 39 EAST, OF INDIAN RIVER COUNTY, FLORIDA. <br />LESS AND EXCEPT THE SOUTH 50.00 FEET OF THE WEST 319.54 FEET <br />THEREOF. <br />AND LESS AND EXCEPT ALL OF THOSE LANDS LYING WITHIN THE <br />FOLLOWING DESCRIBED LINE: BEGINNING AT THE SOUTHEAST CORNER OF <br />THE SOUTHEAST 1/4 OF THE NORTHWEST 1/4 OF SAID SECTION 25; RUN <br />N 73042'59" W A DISTANCE OF 128.50 FEET; THENCE N 88041'47" W <br />A DISTANCE OF 241.58 FEET; THENCE N 07051'35" E A DISTANCE OF <br />26.55 FEET; THENCE N 82058'51" E A DISTANCE OF 59.34 FEET; <br />THENCE N 2002422" E A DISTANCE OF 71.04 FEET; THENCE N <br />68054'01" E A DISTANCE OF 29.42 FEET; THENCE S 21059'58" E A <br />DISTANCE OF 75.57 FEET; THENCE N 89029'46" E A DISTANCE OF <br />151.19 FEET; THENCE N 02016'12" W A DISTANCE OF 326.51 FEET; <br />THENCE N 24022'59" W A DISTANCE OF 187.97 FEET; THENCE N <br />03024'35" W A DISTANCE OF 271.82 FEET; THENCE N 13053'44" E A <br />DISTANCE OF 222.95 FEET; THENCE N 15027'20" E A DISTANCE OF <br />248.01 FEET, THENCE N 75056143" E A DISTANCE OF 63.54 FEET TO <br />THE NORTHEAST CORNER OF THE SOUTHEAST 1/4 OF THE NORTHWEST 1/4 <br />OF SAID SECTION 25; THENCE RUN S 00010'15" W ALONG THE EAST <br />LINE OF SAID SOUTHEAST 1/4 OF THE NORTHWEST 1/4 A DISTANCE OF <br />1324.41 FEET TO THE POINT OF BEGINNING. <br />
